They supposedly did their police report. i was happy, but its been a week and a half now, and i would just like to know what i should do/some kind of status update.
I called the deputy taking care of it (his name coming soon) twice now, once monday and once wednesday. I left messages with the dispatcher because both times she said he wasnt in, to have him call me back asap.
Well, i have yet to hear from him. What should i do…im so close to getting a lawyer/something involved because i have now had to renew my insurance on the car for the winter (i cant take the car until this is all figured out/done?) so im out another 1000$. this is pissing me off
There is definitely something going on, and its starting to piss me off…
The Niagara County Deputy’s name that did the report is Thompson (claim # 54271 if anyone on here has connections that can help me out)…and i didnt even think about this until now but he knew the one guy that was at the shop, because they started talking about the officer just getting back from vacation.
I have off tomorrow so it looks like this is going one step further…fucking shit.
The police called me back. They are ‘investigating it but have absolutely no leads at this time’. So thats a lost cause.
The Repair Shop called me back. Apparently they are NOT going to cover it. “His policy doesnt have theft” ???. So, i have to have MY insurance cover it, and his insurance will reimburse my insurance company…
I have no fucking clue whats going on, but my insurance company (Hanover) said they are going take care of it and get them to cover it/not effect my insurance rates…god i hope they are right or his shop will be lucky if they get a fucking oil change for business…
This isn’t always the case. If his insurance company has a good enough case, they will sue them for it. Pretty common practice I think. As a customer/person, it’s hard to twist people’s arms and get them to pay out, without a lawyer. They know that it’s not worth it for him to get a lawyer, so they just say no. When his insurance company’s lawyers send a letter, they will settle and the two insurance companies will end up splitting the cost or going 60/40 on it.
Well, i spoke with a lawyer on monday just incase, and he said it should be a quick ‘case’ and i should go after him for everything (audio equip, 1500$ for renewing insurance, lost buyer of the car, and his fees…) of course. at first, i didnt want to. i was going to give his insurance company until jan 2nd to give me some information.
Until i drove by his shop tonight on my way home for christmas…what should i do guys…i have a feeling the 28th im going to start the process of taking him to court…i was so pissed.
lol, thats the best evidence i think i can get…and i have pictures on my phone of the car in that same exact spot when i was there monday.
and haha, its the lead singer from All That Remains from there show at Water Street Music Hall a few weeks ago w/ devil wears prada…i do want an f bod though lol
This almost never happens, FYI. You should be assuming that you will be eating the cost of your lawyer, as courts rarely ever award damages that cover your own legal fees.
As for his own insurance not covering theft, WTF? I can only assume you’ve already filed a complaint with the DMV? Or was this not a registered repair shop?
well, we are going to talk to him more on monday…he just got 30 or 40k from my brothers case he did for us, so he said he will work with me if anything…
and i thought the same thing on the theft. and as for filing a complaint with the dmv, i never thought of doing that…and no one else has suggested that lol. guess im doing that monday too!
