You can’t really say that. It takes time to absorb alcohol and it takes time to get it back out of your system.
I could drink 3 beers in an hour and not be drunk but if I drank 3 beers an hour for 4 hours, I would be drunk.

Late to the party but this would suck so bad. .05 is NOT drunk, or close to it. I would happily challenge a random selection of 10 licensed drivers to an autocross or something with a .05, or even a .08. I’d shit in my hat if I didn’t beat at least 5. Just another attempted money grab. The problem is, once some fuckhead proposes something stupid like this, it ends up passing because no one wants to open themselves up to “Rep x. supports drunk driving” campaign commercials by opposing it.
The “don’t drink and drive it’s pretty simple” sounds good until you actually try it in real life in a place like here where cabs are expensive as fuck and there is no public transport. The cab ride from downtown to my house, literally 12 minutes, is about $45 via the meter each way. You can negotiate a flat rate but it’s never less than $35. For the average person to throw that on top of their bar fund every time they want to go out, it adds up quickly. Going out and having 3 beers now costs $100. And who are these friends that randomly like to come pick you up at 4am, sober? I’d like to meet them.
Just accept that it will be zero tolerance next…you are not allowed to make your own decisions in this world.
Example. One beer barely effects an adult male while it may impair an average size adult female, but we can’t have sexist laws so we move to the lowest common denominator.
I just hate that they don’t look into more real problems…like elderly drivers…I can assure you they probably kill as many people per year as the .03 difference

after looking into it a bit the statistics for “alcohol related fatalities” include all fatalities for any accident in which a participant in the accident has a BAC of 0.01… so when some 98 year old slams on the gas instead of the brake and runs down a group of college kids on a bar crawl that would be considered an “alcohol related accident”

I haven’t ever had a point in life where I would exceed 2 beers an hour with out intending to get hammered or drinking a lot…If im going out with friends for dinner I might have 1-2 beers over the course of a 1-2 hour dinner.
This is why you get a DD or use the free cab service if you plan on exceeding a few social drinks…
I fully expect zero tolerance eventually. Look at the recent gun legislation passed, all we need is the right person hurt, or killed and they’ll slip this in there the same way.
The free cab service is one night a year. And I don’t know anyone willing to go out all night with drunk people and NOT drink. Want to volunteer? It’ll be fun! Downtown doesn’t necessarily mean Chip lol but all of the major bar strips are around the same distance/price.

My own thought to this lowering of BAC should be left alone, just change the penalties of the crime. Make people think about what will happen to them rather than how much less they can drink now.

That’s what I was thinking.
Its funny people saying about how they aren’t drunk at .05 or .08, but what they aren’t apparently understanding is that it still hinders your judgment. And if that person is just so all and mighty, how about everyone else on the road. Someone that hardly ever drinks can go out and have 3 beers and hope in a car… how did the three beers affect them?
