No not at all. You do not need insurance to have a licenses. If I didn’t own a car, I would not have insurance. If I borrowed my friend GTO and crashed it, his insurance would cover the car 100%. That is why he has insurance on the car in the first place. The drive is not liable at all for the car (under insurance liability) unless he did something stupid like killed a family doing 150mph. Then civil charges could be brought up against him.
I don’t even think the driver’s insurance can be used as a fallback. When I read my policy I don’t think there is any section that covers me if I drive an un or under insured car. The owner of the car might be able to sue the driver personally for any out of pocket costs, but I don’t think the driver’s policy will cover it.
I’m not sure why any of you are shocked the guy let a friend drive it. If you’ve got 150k to spend no a toy I’m sure you’ve got the insurance to cover it.
Crazy to me is when I see people letting friends drive their cars around a track, something I would never do. A buddy wrecks your car on the street and a nice gesture of paying the deductible is all that’s needed. Wreck it on the track where insurance doesn’t cover it and you’re out the price of the car.
I do believe I know who the owner is, and if you had his money, you would let your friends drive it too. I can tell you this…he didnt pay sales tax on it
Correct for the most part. If the driver of the vehicle has his own insurance and causes serious damage or injury, his own policy could be considered excess.
For example if the owner of the vehicle is insured to $100k, but the driver causes $120k in damages regardless if it is PD or BI, the drivers policy would then kick in to cover the excess damages.
If the owner has $100k and the driver has $100K and lets say he hit a car full of money making adults whos total BI claims came to $300k. First the owners policy would pay out, then the drivers would pay excess, only then when both policies have paid their limits can the driver and passengers in the not at fault vehicle can make an underinsured claim against their own policy.
Edit: in this case, since we may know the owner of the vehicle has some serious cash, he most likely has an umbrella policy for 1-2million. If that is the case, his auto insurance will be primary, Then the umbrella will kick in and the drivers policy most likely will not pay out, but would still be excess after the owners policy and the umbrella.
Humm that is very interesting. I didn’t see that anywhere in my policy saying that it would cover damages done by an other’s persons vehicle that I was operating.
Here is what I have heard from my friend in Brocton about this.
It was in Thursday issue of the Evening Observer (Dunkirk, NY) The accident happened on Rt 60 which you cross on the way to the Dunkirk flea market. It was about 1/4 mile south of Rt 20 and 60. Not quite as busy as the section north of 20 but still a developed area. I talked to a friend that was at the cruise in and he went the accident scene (that I avoided.) and they were just loading the people into the ambulance. He said it went off the road into a ditch, hit and demolished the front end of the GT and went airborne and ended up on Rt60 facing the direction it came from. The wheels and suspension separated from the vehicle, but the passenger compartment was intact. It was designed to protect the driver and has a roll cage that is quite strong. He said the passenger was his daughter and she was approx. 10 to 14 years old. The newspaper had a picture but no names and next to nothing about the accident and there was nothing in todays paper. The owner of the car has lots of money and there is speculation that they are trying to keep the details quiet.
yeah I don’t think I would let someone take that out alone, for some reason, people treat the vehicle different when they’re with the owner than when their watching. I’m just surprised he was going that fast with his daughter.
