Even if you can’t find the proof of sale of the RX7 you do have paperwork (your registration) that at the time you were pulled over that plate was on another car.
And I’d be willing to bet this get thrown out, regardless of what tint you have on your BMW. You weren’t ticketed for tint on a BMW, you were ticketed for tint on an RX7. Since you weren’t driving an RX7 the tickets are not valid. This isn’t a minor issue like being off a single digit on the license plate number, the office got the make, model, year and color wrong which calls into question anything he’s willing to state in court.
However, you are going to make an enemy over a very minor violation and you drive like a douche in a car that any cop could pick out of a crowd a mile away. Unless you’re ready to get rid of your neon tow hook and illegal tint expect to start getting a lot more tickets if you go into court and make this officer look like an asshole.
NY is stupid. There’s no reason tints should be illegal.
On another note - Does anyone know if you can get away with “my car came like this” with window tints? My new car pretty much has limo tints on it, but the previous owner down south (where it’s legal) put them on. I’m surprised I haven’t been pulled over for it yet.
^If hood mounted machine guns were legal where it was produced, I doubt they’d let it slide. I would tend to think that it would need to conform to the laws in the state which it is operated in. When you get pulled over I don’t know how cops could not see inside with all the lights they hit you with.
Doesn’t work that way. It’s illegal in NY so it’s your responsibility to take it off when you brought the car into NY.
Unless the car is registered in a state that allows it. Like when I drive my Texas cars in NY I can have my windows as dark as I want because Texas isn’t retarded like NY.
The tickets should be toss. Seriously if the cop can’t even get the make model color correct he is retarded and not doing his job. If I made mistakes that big at work I’d get fired.
Profiling works both ways. A 50 year old woman who has probably had one moving violation in her life and a Judge who probably realizes that the probability of her doing it again is nil, versus a kid who probably won’t dress properly for court and has multiple records on their MVR along with a completely avoidable tint ticket… guess who’s getting fined?
Pay it and move on, I don’t know if you can comprehend this, but paying the $100 is far better/easy than wasting everyone’s time involved because you feel that you’re going to “one-up” the legal system because a cop made a mistake. You’re probably just going to peeve the judge even more by trying to argue your case and get fined regardless.
I’d get over the cops mistake, he’s not supposed to be an automotive historian, and to Beck’s point it’s really not a fight worth fighting.
Biggest question I have here is receiving two seperate tickets for what I assume to be one side window offense (just trying to understand the law here). NY Law states both side windows on a sedan must allow 70% light transmittance. You obviously violate this at 19%…but I’d bring that question up to you’re lawyer guy, try to fight the writing of law and not the cop here.
according to law in ny the minimum amount transmitted through the window is actually at the percentage right from the factory of the clear glass. ANY window tint on the front windows is illegal.
yes the cop screwed up and i can understand not wanting to pay the fine, however when you go to court the da will say it doesnt matter and he can have the cop just rewrite the ticket properly.
i wouldve just paid the fine and not bothered dealing with this. ive gotten a ticket for tint twice, just paid it each time. im not taking my tint off(35%) and i am content with the possible fine that may result.
This only works if the cars is model year 91 or older. The law re:tint was changed in '92 and cars manufactured prior to that date are subject to the law at their time of manufacture(good luck finding the previous regulation).
That doesn’t mean the cop won’t give you a ticket for it. Cops will still ticket you for it, and you have to go to court to sort it out.
That also doesn’t mean you can buy and old car and tint the windows, just that if you have one with tint, you don’t have to remove it.
It’s a pain in the ass.
My past experience with tickets being wrote up wrong/typed wrong is that they are done wrong by the Cop, so you get off Scot-free. I’m not a lawyer or anything like that. But when I went to court back when I was under 18 and didnt have a night license… the cop wrote down the wrong section number for the ticket which made the whole ticket incorrect then and the judge said it was dismissed because of that.
They messed up, the point is they have the wrong vehicle… you cant be charged for what the ticket says.

From what I was told, the light transmittance of most factory glass with any sort of UV protection is right around 70%. Cops in NY will write a ticket if there is any tint installed on the front windows (unless you have a medical waiver).

Why does everyone always say pay it to play it, How about Fight it and play it. Who says you cant fight something and get a lower charge or off all together? Sorry, but if I can get out of something… why the fuck not. Grimmy? no. Having someone pay for a lawyer, the judges/pros know the laywer, so you get off scot-free and you are in and out right away. Thats grimmy in my opinion. They should have to wait in line just like everyone else… Because one can afford a lawyer and the other cant, should not make it justified by the order they are taken in.
Oh, not her, she’s quite possibly the worst adult driver I know and has the tickets/accidents to prove it!
I agree though, I run one plate on one of my cars and will pay the ticket if it comes, and then try to avoid that town. Fortunately the local cops have never bothered me for that or the exhaust.

The part that gets me the most here is, I just can’t imagine having the kind of time to even consider fighting something so trivial. Is your time worth that little? Or do you just have that much of it on your hands? I mean dude, you broke the law and got a ticket. Just pay it. I have an illegal exh. on my Esprit, and every now and then, I get stopped for it. I handle it and move on. In fact, usually the cops let me move on without even a ticket, because I’m very courteous with them through it all.
