Anytime I hit something I have stoped, cat, tree,etc, he was probably too drunk to realize what was going on. Honestly he needs to go to prison for life with out parole. He chose to do what he did, he could of called his wife to pick him up or anyone that was sober that night… Hope he rots in hell or gets run over by a drunk driver

He’s definitely much more to blame than her, but she’d be live today if she had just been on either of that nearly brand new sidewalks that run down both sides of Heim. Talk all you want about the legal right to share the road… When you get hit by a 4000lb car that didn’t see you crouched down on your skateboard at night you end up “dead right”. The reasons why the driver hit you and how much at fault he is won’t bring you back.
I certainly don’t drive a BMW but when I hit something with my workin man’s Ford truck, I STOP, PULL OVER AND SEE WHAT THE FUCK I JUST HIT !!! Deer, duck, rabbit, pothole, whatever. If the impact caused that much damage, WHY would you not hear anything and WHY would you not stop…unless you knew you were shitfaced, hit somebody / something, and thought you could hide the evidence. A lifetime of good work and good deeds does not earn you credits for when you make a catastrophic mistake.
That is such an excellent point, and sums up how I feel about all these Lance Armstrong assholes riding all over the place. Sure, they have a legal right to share the road, but it’s seriously stupid as balls when I see them riding down main street or transit at 4 in the afternoon in a lane. Doesn’t matter if you have a legal right to share a lane with me, I’m 4000lbs and you’re 200. If I hit one of them, I’m totally at fault, and I don’t disagree with that, but it doesn’t change the fact Lance Armstong is dead. Im always amazed at those guys. Go ride in the country or something. Not rush hour traffic.

I recently had a debate (aka argument) over this topic. Some dickbag on a bike was on a narrow road and I damn near hit him when he drift away from the curb. This turned into me arguing with a passenger my belief on “self preservation” and how I think while technically illegal, riding on the sidewalk AGAINST traffic is the way I’d roll if I was on a bike. I like to see what’s coming at me, when it’s a vehicle especially. I don’t agree with 100% blame if she was on the road and not paying attention. That said I think the doctor severely fucked up and the burden of responsibility is on his shoulders. He chose to get drunk, get into his car and drive while drunk. He was in a boat of a vehicle and impaired thanks to his own choice, he should have called a cab or ride.

Depends on the municipality, but in a lot of places bikes and skateboards are prohibited from sidewalks. One of my friends used to skate to work and got ticketed for skating on the sidewalk.
Leaving the scene of an accident is a slap on the wrist. I’m pretty sure leaving the scene of an accident resulting in an injury is a felony.

SRSLY? That would be pretty funny to see. Of course I quit skateboarding when I was about 16 and the government wasn’t as broke back then, guess I have distorted time mentality. They probably ticket people every chance they get for petty bullshit these days. I love the concept of big government and the way they punish tax payers several times throughout the cycle. The icing is the bogus fines and nitpicking bullshit, kicking people when they are down to justify their paycheck. I think back and I had many close calls with cars, guess it just wasn’t my time. Anyhow…I’d still take my chances on the ticket personally and try to avoid cars.
That was about 15 years ago back in Saratoga, it’s nothing new.
I’ve only done this for short distances and it is almost always terrifying. People in cars really aren’t looking for something moving 10-15mph in the wrong direction down the sidewalk when they make a turn.
With the direction of traffic on a sidewalk that isn’t being used by pedestrians is sometimes better than riding in the street. I used to ride down NFB for a short distance this way. Be prepared to watch over your left shoulder at every intersection and parking lot approach (I suppose you’d have to do this riding in any direction). Yikes. And get your path blocked by wacko Tim Horton’s customers. For a short time I was riding in the street on my commute on NFB, and after having people intentionally get as close as possible to me, beep for no reason (I was being respectful toward motorists and giving them enough room to pass in the lane next to me), and having 2 bottles lobbed at me, back to the sidewalk I went for this part of the commute…
The truth is, though, that if you’re predictable on a bike 99% of motorists are very respectful. Of course, it only takes one…

The defense had an answer for every piece of evidence.
BAC… Brought in an expert that showed the machine hadn’t been calibrated properly and the vials weren’t sealed properly, introducing bacteria that feed on blood sugars which gives off alcohol.
Speeding… Brought in their own expert who pointed out mistakes APD made in their reconstruction putting his speed just under 40.
I think the most damning one was their expert showed the jury the long board with the white line paint transfer on the wheels. The defense was adamant that she was entirely riding on the shoulder and that paint proved they were wrong. The defense never had an answer for that rather large oversight and once you introduce doubt on such a key point it’s a slippery slope as to how much of the other evidence is 100% accurate.
Our system is one of proof beyond reasonable doubt. That means it’s design is one that would rather see a guilty person go free than an innocent person convicted.
And PS… I stand by my early comment… If you ever fuck up huge, Joel Daniels is the guy to call.
