to answer Boosted’ earlier post the reson I think 3rd degree is BS is because in the case of the bartenders how can they tell when you are legally drunk. I can drink a lot before I;m feeling it. Whitey on the other hand is a blabbering vagina after 2 beers :smiley: j/k

And with the legal limit so low in PA thats BS becaus I could have 2 Hard drinks and show no signs of being legally drunk and if I go out and kill someone and my blood work comes back over the legal limit that bartender can be held acocuntable too. Sorry that BS…

It is BS. I know the law states what it does but that doesnt mean I have to agree with it. I just hope they drop all murder charges and just stick him with the dealing. :crossesfingers:

this is true and also not true. granted it is the law that if the bartender serves a person over the legal limit. aka the “red zone” they may be held liable. I am not quite sure if you understand this law to its entirety. i know you know the laws and all but this is one that i know to the T. one because i was a certified bartender. two because i was involved in a case that dealt with this law. we can talk more about it at the christmas party if you like.

and on a side note, it is anyone that serves the person the drink. so if you are at a restaurant the server is liable.

in no way do i feel this is in the same ball park as a drug deal. she had a bad reaction to an illegal substance. the drug dealer was in the wrong for trading narcotics. but in no way did he contribute to her death. but this is just my opinion
