legally define slander for me...

a few people have been talking a lot about our manager who was recently fired. well his sister is a huge bitch. so to be a bitch she has been looking all of us up on myspace to get our screen names, or emails or whatever, and she is harassing us saying she is going to charge us for slander, and defacing someones name. so legally define those 2 terms for me and if this lady even has any idea of what shes talking about. how can you sue someone just for them calling you a scumbag, or pussy, etc.

Slander is writing something about someone in a public form

Libel is saying something of negative consequence about someone.

Those are the basic definitions…as far as law goes…I am not educated enough

im not sure to be positive but i think you can only get charged with a slander type crime if you say something false about that person and then it negatively effects their career… like and example would be.

if the news papers started writing a story about a politician which were lies and then got them fired… thats what i recall from C.J. class

basically, if everybody thought the guy was a douche nozzle, then calling him a douche nozzle is not slander. But if everybody thought he was a nice guy, and somebode called him a douche nozzle, then THAT would be slander.

i would think as long as you don’t have things written about him online on your myspace account or someplace else and its just you guys talking about him she wouldn’t be able to prove anything anyway.

looks like she’s the one harassing other people. She doesn’t have shit. The most she can do is go and file a complaint about it. Nothing will happen though because it happens all the time.

In order for your “slander” to be taking into account, it has to be proven that what you said or posted online, directly affected his job or career, or possibly defamed him. Since you are not a CEO or something of a major company, you cannot readily affect his next job oppurtunity, unless you made some massive public display that got on the news, saying this guys a fuckhead.

So dont worry about her, and Counter-sue for harrassment if any of it goes through.
