This has been going on long before the patriot act. You guys should get out of WNY once and a while. Try cruising Rt 37 between Alex Bay and Massena, NY. They have random Border Patrol checkpoints setup there all the time, and were doing it back in 1995 when I first started driving to Buffalo. I can remember seeing them even before I had my license.
They do it because good smugglers are smart enough to sneak around the custom’s station, but often let their guard down once they’re here and just cruising down some state road.

Like he said this is very common down there. I was north of San Diego and they had these set up. Now that I think of it I was driving form the Grand Canyon to La last November and ran in to one of these in NM.
On one hand it amazes me that the immigration/smuggling problem is so bad they catch people on major thoroughfares in broad day light. On the other the guy is correct in standing up for his and our rights. I have never said no to an “unreasonable search” because it would put me out too much and I had noting to hide. If it tied up traffic blame the authorities for not having the proper facilities for the operation

So, let me get this straight, you get pulled over for speeding by a trooper, he asks you to step out of the car and put your hands on the hood, he sits down in your drivers seat, you tell him to get out of your car as you don’t give him content to search, he ignores you and looks through your glove box, and everything else…

If you refuse to step out of the car, you’ve refused to comply with a reasonable and lawful request from a law enforcement officer. That gives him reason to believe that you’re up to no good.
There is an exception to the law that applied to this idiot’s situation. They could have arrested him, don’t know why they didn’t.
