The guy in the car was completely wrong. The bp agents have the right to pull him to the side for questioning, not a search. If the questioning provides pc for a search, only then can they search the vehicle. He flatly refused to comply with anything the bp agents said, and managed to be a complete dick about it too. I wish they would have put him under arrest and read him the rights that he really has.

If they see something in plain view or your actions dictate it, they can search your vehicle without a warrant.

So your officer made a mistake. That doesn’t change the fact that there’s plenty of situations just like yours that the officer acts within the law.

Btw I was pulled over in cheektowaga a few months ago for a license plate bulb being out. The officer politely asked me to step out of the car, and politely asked me if he could search the vehicle. I refused, he asked me a few questions and let me go. Not all cops are out to get you.

They can ask you out of the vehicle but unless they have a specific suspicion of wrong doing in progress other than a traffic infraction they need consent to search your vehicle. If they see something in plain view or your actions dictate it, they can search your vehicle without a warrant.

Any time an officer has to ask you whether he can search you or your property, it means that he cannot legally search you without your consent. Refusal to allow a search and insistence on your constitutional rights does not give rise to probable cause, which would allow the police to search you or obtain a warrant. However, the way in which you refuse a search request could give rise to probable cause.

General rule of thumb, if they ask if they can search, they can’t. They’ll just do it if the have cause to and can.

I think what he’s trying to say is that if a police officer really wants to search your vehicle, he can and there’s not much you can do about it, and they can come up with a reason later. I’ve seen a cop or two like this, but thankfully 95% of them are good people doing their job.

Yeah, get more than 2 hours of sleep, which I didn’t

KNOW YOUR verbs,proverbs,adjectives ect… and pay attention to pre and suffixes.

Just use common sense, if you’re not retarded you will pass, about 100 people took the exam and i’d say maybe 60 or so passed it.

I wouldn’t let anyone search my car without a warrant either. If you do you are setting yourself up for prosecution. It’s the same reason you don’t speak to the police if you didn’t do it and have no information about whatever it is. Saying something the wrong way can get you in trouble if the police think you did do it. Thats why we have these rights, so the innocent can’t be unjustly tried.
