I applied at a open interview thing on one of their computers and two weeks after taking the test I got a letter saying I said I did all these bad things, like I have been convicted of a felony, drug charges, violating immigration/customs laws, etc. There were eight things listed. I have tried pot twice in my life summer of 07 (didn’t even get high i guess, what a waste). I was told that “if you believe this determination was made in our error you mat submit a written request for reconsideration.” I wrote a letter debunking all the rest and said the pot purely experimental and that was something that wont happen again and since then everything else has been completed. That letter was written before I sent in my paperwork, before the oral interview, and before the physical. So I must believe that it was acceptable. I haven’t received any thing but congratulations you have passed ‘x’ requirement. All I can do is wait

No, he wasn’t. Yes, they can pull him over if he’s committed some violation or otherwise drawn suspicion on him. They cannot search his vehicle without a warrant or his permission unless there is illegal material in plain sight upon his appraisal of the situation. If they do search the vehicle regardless, the evidence cannot be admitted into a court of law, and the officer may be terminated.
Yeah, the guy in the video was being a douche alright. The Border Patrol agent. I have a friend in the Border Patrol. I respect the need to keep our borders secure to the point where we know who and what is entering our country. This does not grant them carte blanche to randomly search people inside the territory of the United States.
Uh, yeah, I guess they can, in that they have a gun and can physically overcome you. However, people have successfully defended themselves for assaulting police officers when those police officers were conducting an illegal search and the individual felt their constitutional rights were being violated. I’m not saying that’s justified, but an officer has no right to detain, search, or otherwise utilize their force of law without probable cause, and I fucking respect this guy for fighting one small fight for individual liberty.

When i was living in arizona they had checkpoints on the highway that wasnt close to the border either. Everytime I would go through it the BP would ask to roll down all the windows, bring the dogs around and in some cases open up the doors to look inside my truck without asking permission. I cant see the video because it says its unavailable now, but maybe where the checkpoint was, it was an area where alot of illegals come through.
That pisses me off. There is absolutely no justification for activity like that in America.
A lot of government checks ask “Have you ever taken a narcotic?” So technically, if you have taken perscribed Vicodin, you have taken a narcotic. Do you answer yes?

They will ask you retarded questions, that do not make sense, because they ask them backwards/not like a normal phrased question, designed to confuse someone under the influence
if you struggle at all with the questions, they have “reason to believe” you have been drinking, which is probably cause, which is enough for them to search your car

Probable cause is if there is suspicion of having an illegal weapon or substance in the vehicle. Alcohol is not an illegal substance.

Yes, they have probable cause to detain you if you appear to be drunk. No, they don’t have probable cause to search your vehicle - because the crime that they suspect you to have committed has no definite relation to what you might have in your car. They can’t search your car under those circumstances any more than they could search your house.
Now, if you have a baggy of oregano sitting in your cupholder, and they see that, now they have probable cause to believe that you’re in possesson of illegal drugs, and can search your car, because it is in plain view.
They can’t get away with it. If they pull you over, ask you if you’ve been drinking, no matter what you answer, they cannot search your vehicle without your consent or a warrant. They can detain you on the side of the road until they get a canine unit in, and use that for probable cause. They can detain you until they get a search warrant. They can ask you if they can search your car.
But if they search your car and find something, it’s inadmissible as evidence in a court of law. And whether or not they find something, you can sue, and the officer will probably lose their job.
