You’ll only be arrested if you threw the first punch, so to speak. Wheres the rest of the story? If you had to KO someone because they came at you with intent to hurt then your case will be dropped b/c it was for self defense. IF you ran up there banging on the door/window and then words exchanged and you threw the first punch outta of aggravation.
Then yes you will be charged with assault. Which is a felony.

i doubt you “need” to go to the police station for anything. they are making it seem like you need to so they can interview you. bring a lawyer.

Thank you. The detective said he would meet me somewhere but preferred I came to the station which is down the street from my house. The lawyer was really nice and said he will help me out so after reading a lot of peoples opinions, no harm in having the lawyer come with me tomorrow. At least I then have someone on my side if the cops try to do anything to trap me.
I’m really surprised he can get away with living in his car. Someone needs to set the car on fire, on a night when you have an alibi. 
Haha ya. The police have been called before. The lady who he drives to work you can hear at night yelling at him and saying stuff like “Get out of here you sick son of a bitch” and shit about him being a pervert and shit.
Cops just said his plate is registered for the apartment below us so he has the right to be there. He just smokes in his car since he cant in the apartment even tho I have never seen him a) smoke or b) go inside

Thats a good idea. I will ask the lawyer tonight. If it goes to court, I think I will def persue this with a background check. Hell, maybe he has a history

Haha ya still here. I spoke with Jeff monday night about what happened and he gave me some info. He was pretty good and gave me some heads up and said what a lot of people on here did, dont trust detectives and I am glad he went.
For the people who want to know what happened, here is the story now that I have submitted my statement to the police and its up to the DA where it goes.
Early Monday, I went out to my car parked in my apartment parking lot around 1230-1am for a cigarette becuase one at night helps me sleep sometimes. There is a older guy (late 50’s) in my complex who drives the lady to work below me at night and sleeps in his car all night and day. He has tons of stuff in his car and even has a full tool kit from working on his car and changing brakes in the parking lot. The police have been called on him before becuase of people coming in at 3 am see this guy in his car every night, it freaks people out. They said that his car is registered to the apartment downstairs and there is no problem with sleeping in your car. Also, anytime she gets out of the car, you hear them yelling things at each other like “fucking pig” and things like that so since we moved in, this is the impression we have gotten of him.
When I went out, he was parked in his SUV EXTREMELY close to my car (see pic below of the spot he was parked in). His window was rolled down and he was laying in his car so I knocked on the window and asked him if he can move his car and not park so close to vehicles. He immediately got hostile swearing telling me to fuck of, “I dont give a shit if your fat ass can not get in your car”, etc. I said if you ever got out of the car, you can see how close you are. He still was swearing, threw the door open into my car (no damage) and stood between me and the front of my car and had me between the two cars.
He made a move at me so I protected my face with my left arm and swung with my right and connected. He blocked my exit from the cars, I have no idea what he had in his car (bottle, wrench, weapon, etc). He fell down, I ran inside and placed the 911 call.
7 west seneca police cars show up and about 9 officers including the lieutenant. they immediatly started accusing me saying that i have no right to knock on his door, one officer after I asked “If he is blocking my door, what am I supposed to do” said “Climb in your trunk”. They also asked why did I go out to my car so late, where did I plan to go, etc. I showed them my lighter and told them I didn’t even bring my phone. I also got a little lippy after they were being complete assholes to me when I was obviously worked up. I did say “7 cop cars? You guys must be bored”
Anyways, they just took my information and said the guy was at the station already. I got a call later that day from the detective saying he needed my statement and asked what happened. I went with the lawyer and he caught the detective trying to turn things around on me. He said that the other guys report stated that he had 18 stitches on his head, a mark on the other side of his face, and choke marks and claimed that I hit him more than once and chocked him.
I found his report completey crazy. A) hes a 60 year old guy and I am a 24 year old 6’2" guy. If he came after me, my fear was he was crazy, had a weapon, or drunk.
B) the mark on one side of his face is probably from where he fell. the marks on the right side were probably from an open hand hit when i covered my face with my left arm and swung blindly with my left. My thumb nail is bloody under the nail where it took an impact becuase obviously, I was not in a fighting stance with fists made.
C) if I hit him with a open hand and he fell down (where the mark on his other side of the face came from) why would I hit him again or choke him?
The whole situation is BS. The lady below me is already at the complex office at the apartment and apparently the guy is her husband. The cops knew of him when they showed up so I am sure this guy has a record somewhere and this really is against me with no record or arrests which the detective verified. The lady below me works at a hospital aparently and him obviously fight and he sleeps in his car so my worry is that he has marks from her that he is blaming on me.
LOL that is a pretty good story. Should have hit him more then once. Jus sayin.

I honestly don’t regret hitting him. I honestly did not know what he had in his hand and really did not want to take a socket wrench or beer bottle to the head to find out.
I hope the DA sees it the same and doesn’t just look at a 24 year old and a 60 year old on the papers and brings it to court. Hopefully he has a clearer head than the cops did that pretty much blamed me from the minute they showed up to my apartment after I called 911.
