You don’t have to be. You could be anywhere in the world. Even your own home, here in the United States. These are people we capture ANYWHERE.
Meh, I guess I’ve got no problem with it. It pretty clearly only applies to uninvited guests, who should just be booted back over the border/ocean anyhow.
It says “alien”, which means they were here,
Again, please post a link so we can see the entire bill.
I just posted the entire section. That’s the only part that has anything to do with it.
And no it does not mean that they are IN the united states when captured. Considering this is mainly about people held in Cuba that were captured in Afganistan, I’d certainly say it doesn’t mean that they were captured here in the US. It means they are non-citizens in custody of the united states.
`(1) UNLAWFUL ENEMY COMBATANT- (A) The term `unlawful enemy combatant' means--
`(i) a person who has engaged in hostilities or who has purposefully and materially supported hostilities against the United States or its co-belligerents who is not a lawful enemy combatant (including a person who is part of the Taliban, al Qaeda, or associated forces); or
`(ii) a person who, before, on, or after the date of the enactment of the Military Commissions Act of 2006, has been determined to be an unlawful enemy combatant by a Combatant Status Review Tribunal or another competent tribunal established under the authority of the President or the Secretary of Defense.
AND JUST FOR YOU BABY:
(3) ALIEN- The term
alien’ means a person who is not a citizen of the United States.

edit: to slow am I
Yeah I’m aware lol
look at my edit
yup, nope had to fix the link to the bill…won’t let me link directly to the text
Anyway, basically for this to affect you the following has to be true:
- You’re not a citizen of the US.
- You’ve been declared an enemy combatant.
- You were picked up here or in one of the area’s we’re at war with.
These aren’t some car theives who the BPD picked up downtown. These are people we are AT WAR WITH. Innocent people will be arrested, it’s an unfortunate part of dealing with an enemy that hides amoung it’s host countries citizens. Since 232 people have been released from Guantanamo there is obviously a procedure in place if you’re truely innocent. If you’re picked up though chances are even if you’re not a terrorist you were living your life on the edge between terrorist supporter and terrorist simpathizer.
What I think you’re failing to understand is there has to be a difference in the rights given to citizens of your country and citizens of countries you are at war with.
If anything, they’re probably being a little too lienient on determining if someone is “innocent”, considering at least 10 of the people released have re-joined the fight against us.

Read the first post…where did I say this applies to US citizens anywhere?
I don’t care that innocent people will be detained. The fact that we can hold someone for any length of time without telling them for what they are being held is a slope this country should never come close to sliding down. I know there’s a difference give to citizens and non-citizens. But the war on terror is not going to be won militarily, it’s just not. Holding innocents for lengths of time with little to no contact with family, torture is not only going to breed more terrorists but it’s going to turn the innocents that we held into terrorists. So what happens after you’ve stopped 1 attack but created 100 more people to plan 10 more attacks?
YAY!
