^ Partially. You keep walking in the same leak day after day? If it’s the only bathroom then it would be against some sort of working condition standard (OSHA?). The problem is common sense need not apply to any lawsuit anymore.

Nope not at all. BUT, if you KNEW there was a leak in the bathroom (presumably on a tile floor) would you continue to take a chance and walk through it again and again? I would use a different bathroom, regardless if they were going to fix it or not. It’s dumb as hell to keep walking through it.

If there is no other bathroom, then you have a point. But say there are two bathrooms not too far from each other. The one closest to you has the leak. Would you continually walk through the puddle or use the other bathroom?

Oh I dunno, use a different bathroom perhaps? If there is no other bathroom report the company to OSHA and/or whichever bureaucratic group best fits the problem you’re reporting. If you understand the risks yet continue to take them you are accepting the risk.

The more I think about how silly this all is…I have to wonder something. Are employers even required to provide you a bathroom to use? How regulated is our work environment?

I think unless you are running a banana stand or something the employer must have a bathroom. I’m not sure what would be required to make it mandatory to be handicap accessible.

Anyway, as I said before, the employer is at fault because they provided an unfit working environment where this gentleman was tormented daily. The KKK thing and the monkey from a noose thing are a little more than office antics. It was reported (from my understanding) multiple times to managers and nothing was done. As stated above If I was the manager I would have warned the employees and told them if it happened again they’d be looking for a new job.

If you do everything in your power to prevent workplace discrimination or in the case above safety, and nothing gets done, then the employer absorbs all the blame. If you don’t tell anybody about stuff like this or continually do unsafe things that could be avoided, then you should get no sympathy from anyone especially the judicial system.

The lady with the coffee got what she deserved, third degree burns. She was dicking around with hot coffee between her legs and spilled it. Her fault 100%. It’s the same reason you don’t wear a white shirt while painting, or eating BBQ, or changing your oil.

why did this guy not call the cops. It it was so out of control, the employer did not do anything. Then call the police, press charges, get restraining order. there is more to this story that we dont know about.

Yes. You must have a bathroom for your office unless it is deemed a mobile facility or one that is not attended 24/7 which a food stand would qualify. I think requiring a certificate of occupancy checks to make sure you have a bathroom for each sex and the required number depending on how many people are working there. If you serve food and have a place for your customers to sit and eat which you own (not a shared space like a mall which would fall under the malls responsibility for providing the space), you also need a public bathroom. If you are not required to have a bathroom, you must allow your employees to leave on short notice to go to the bathroom.
