Its true. You need to be laid off (for sure) or fired(i think) to be eligible. Anyone can go and file the papers when the lose their job and most companies will pay if without fighting it but if your company is saying that they fight it and win, then that means if you get fired they will win since you got fired.

Here’s what happened to me. I put in 4 weeks notice in writing I was going to college and would be leaving. The day before I left the schedule for the following week was out, and had me on it. I told the manager on duty that I wasn’t able to work and to see my notice of resignation. She claimed they never filed it, etc. So I said ok well tomorrow is my last day no matter what, and sure enough it was. The GM and I were long time friends (and he was going to be leaving the company soon anyways), and he asked me since I quit if I was going to go for unemployment and I said no, but he said to apply for it and he wouldn’t deny it so I could get some free $$$ to help in college. So I did, and for 6 months I had like 200/week or so for free.

When I filed they didn’t ask me any questions, just that they would notify my former employer and if they denied it they would compare stories and go from there, never heard back from her again.

So yeah, if they say they will fight it, more than likely the unemployment office will rule with them, my story is just lucky because the GM didn’t care.

i quit and i got it. i however had a legitimate reason to quit.

roll of the dice is how it works.there are cases where you can.I was wrongfully fired and arrested from a job.I was granted unemployment.which the company. Contested.I went to the department of labor hearing downtownthe company brought a lawyer and I showed without reasonable doubt I was not guilty.the unemployment judge even wrote a letter to the cheektowaga judge on my behAlf. I know my case is way off topic and has no relevance. All I am saying is you can show without reasonable doubt you deserve it.like for instance the working conditions were inhumain or you were not getting paid.or your employer violated your civil rights then you win. i just spent some time looking through the laws and such and there was one i couldn’t find that i thought existed…

one of my bosses/employers told me it was NYS law that a company have a schedule posted 2 weeks prior to the first day of that scheduled week you are to work? said past boss also told me that employers can get in a lot of trouble for waiting until the last minute to post up a schedule…was i misinformed?

I know that my work just recently got a memo from the company about it being necessary to post the schedule two weeks in advance. I thought it was just a company thing but could be law.

can anyone find out if its a law that a employer needs to supply you with there fed id# if asked ??
