So I bought a car from a necc member thinking it only needed “wire harness” work, that is what the seller said, so I bought it. The second day I took it to my mechanic he then took a look at it. He took apart the valve cover seeing that parts were missing and parts were in places where there not supposed to be. He also told me that the previous owner did know about this because he could tell if the valve cover was taken off before or not. The seller told me everything was fine, engine was in great shape. On the bill of sale it does say as is. So im I fucked or is there anything I can do about it?
confront the seller in an appropriate/mature manner and see what he says. . .
Even if the seller tells you that nothing except for one thing is wrong with it, you should have taken it to a mechanic first, doesn’t matter if the guy says he’s honest or not. There might be other things that the seller didn’t even know about. You could have gotten a price drop or refused to buy the car at all.
As for being fucked, you did sign the paper saying as is. . .
just bring this to the guy’s attention, then take it from there. . .
i’ll buy it from you for 3K
You bought another 240…
nvm, just saw your thread in the fs arena
As nismo240r said, you should have gotten it inspected before you bought it. Even it if your buying the car from your best friend it is in your best interest to get it inspected.
Hopefully you get things straightened out without paying an arm n a leg.
if its the sil40 it was running after the engine was put in. so im not sure whats wrong with it.
ouch dude that sucks! Hope your engine isnt fragged.
wha are those things covering your spark plug hoses
I remember the classified ad on this car too. The owner was like (in similar words) “I don’t know what’s wrong with it, won’t start, probably the wiring harness”.
Blatant lie is what it is. You can be the most oblivious person but when you are driving and mangle up a valvetrain like that there is no way you can blame bad wiring.
While you did buy the car “as is”, the owner wasn’t being honest which is fucked.
Rocker arms… probably overreved the piss out of it. They would have blown off and caused quite a noise. LMAO… “bad wiring” my ass.
just to let you know from the thread as well. the owner never got a chance to drive the car as it was in the shop the whole time.
It’s up to the buyer’s due dilligence to follow all the proper steps in purchasing a vehicle. I mean both ends didn’t do the proper steps in completing that sale, on the seller’s end, that’s actually illegal whatever they did saying yeah it runs fine but really it doesn’t and not disclosing the true nature of the car’s condition and history.
Now on the buyer’s end, it’s you’re responsibility to make sure you do the research required on the particular vehicle. Especially the history on the car, take it for a drive, get a mechanical inspection before signing any documents or leaving any money on the table. Clearly it doesn’t seem like any of that was followed…
The long and short of it all is yes what the person selling was wrong because was the seller a qualified mechanic to diagnose the problem? The buyer didn’t follow the appropriate steps to make sure what they were buying was the real deal…As for the “As is” clause, once that’s on there it’s pretty difficult to back out of that, again the courts will look at both parties and basically dismiss the case…the “As is” got the seller protected because from here on out it’ll be more or less just hear say…
The solution would be to confront the seller to rectify the problem, going through small claims court is just going to cause headaches and heartaches and a waste of time all because of the “As is”…
If you do want more clarity on this, consult the Alberta Motor Vehicle Industry Council,
All your questions, comments and concerns can be directly looked after by them, they are the governing council that monitor the motor vehicle industry according to the Fair Trade Act…you can also contact them, they have a 1-800 number on the website…
THE MORAL OF THE STORY…DO YOUR HOMEWORK PEOPLE…MAKE SURE YOU DO THE RIGHT STEPS…IS IT UNETHICAL? WITHOUT A DOUBT…HOWEVER…TO SOME SELLERS IT’S NOT UNETHICAL, IT’S JUST BUSINESS…BUYER’S BEWARE
you never let me drive the G before I bought it. . .
you never let me drive the G before I bought it. . .[/quote]
That’s 'cause I knew you wanted it
