Effective October 1, 2008, HB 137 revises the traffic laws to create a few more penalties. This short bill was particularly focused on unsafe motorcycle activities, but it does include a provision for excessive speed. The new law also provides penalties for the first, second, third or subsequent violations. The Distribution Chart found on the FACC website will be updated to reflect the amounts for the first and second offenses in the Traffic section. The third and subsequent offense is classified as a third degree felony with a $5,000 fine and will appear in the Criminal Traffic section of the chart.

New Violations:
316.2085(2) Motorcycle or moped, wheels losing contact with ground
This is classified as a moving violation.
First Offense: the violator must pay $1,000 plus any other costs assessed for a moving violation. Second Offense: the violator must pay a fine of $2,500, plus any other applicable costs assessed for a moving violation. The person’s driver license must be revoked for a period of one year.
Third Offense: the violator will be charged with a third degree felony, punishable as provided in ss. 775.082, 775.083, and 775.084, a mandatory fine of $5,000, and the driver license must be revoked for a period of ten years.

There was also talk on a 3rd violation of confiscation of the vehicle…

sooo ridiculous, i guess its because of people doing 100 over or doing wheelies and folding their tags up and running from the police… I on the other hand was doing NOTHING but cruising at the speed limit when i was hasseled. He followed me for about 7 miles, no joke.

btw, those fines have increased i heard, i was just going off what the trooper told me.

but repeat offenders will get screwed. :lol: 50 over is so easy to do on a bike, especially around town. not to mention, A friend and I were cruising with traffic at about 85-90 and a trooper walked us like we were not even moving the other day.

I think 50 over is loss of license and 1000 dollar mandatory fine.

BTW< how is a improper tag display a moving violation?!?!?

I heard a state representative mouthed off to a cop at bike week and got a plate ticket… I wonder how long till this penalty is reviewed. Of the cops I’ve talked to down here, most of them say, theyd never write that ticket, its ridiculous.

I wonder if we have a fine like this in NYS. My tag is def tucked up under my bike and I would hate to get surprised with a nice fat ticket.

As far as I know its no where near as strict, besides, ive always been given warnings.

x2… as long as you are not being a complete asshat and everything else checks out they usually give warnings.

wow what a dick. i wouldn’t even think that your plate mount on your 10R is grounds for pulling someone over. that’s bull shit. the gsxr i could see getting ticketed, but not the 10R.
