since I do this for a living I might be able to help you out… you said you have the right of way… so was the accident ruled your fault or hers? If it was ruled her fault you are entitled to a rent-a-car by law, like you should be in one right now if it wasnt your fault… they will give you one until they estimate the damage and actually total it. I would call and find out for sure.

I can’t believe you didn’t get her info and trust the cops report. I have been hit 2 times in the past 3 years and everytime I got thier info, called their insurance, and had a rental car the same day. When you wait for the cops, you’ll get screwed everytime. I’m not busting your balls, just an fyi for next time. If you want something done right and done quickly, do it yourself.
I hope everything works out. Is your frame bent or anything like that, you may be better off totalling it and getting a new car.

And a guy a work with who stopped at the scene and saw the car thinks my frame is bent… but the problem is that if they total it they are only going to give me what it’s worth, not what I owe. I owe $6,500, it’s worth $4,200.

If you hit her, I don’t want to see the outcome. my brother got hit with the “you should be in control of your car at all times” when some tool pulled out in front of him. luckilly he only lost his $500 78 nova and not a $6500 car.
its their fault… make em pay. go to hospital for back and such … settle out of court for 3k and call it a day. not like youre trying ot get rich off of anything. just trying to pay the balance of your car if they dont pay you for it. but id go to the hospital just so you have another means of paying off the rest of your car. if this shit makes sense.
I agree - at least goto the hospital in case the shit hits the fan and you need some more material for the judge. It can’t hurt any to make the trip.
The police report says “Unit 2: No contributing action”.
From the look of the police report, I’d say I’m in the clear… but I still have to wait for Erie insurance to call. If they don’t call in like 30 minutes I’m going to call them.
