kev, i’m going to address your concerns here rather than through pm.
i;m not an expert but i do advise people on this stuff alot. for reference, i do have 17 tickets and my record is clean and my insurance is cheap… fight them fight them fight them and be creative with it.
from your explanation i take it you got the ticket on the highway. if you got it on the 401, which it sounds like you did, you likely got a ticket from the OPP… kind of like the State troopers vs. regional police.
OPP are much less likely to show up in court for various reasons. there are rumours that they dont get paid to be in court, some say that the courts now assign all offenses for a particular officer to the same court date so that he fights them all on one day… i know that that is at least partcially true… however, whatever the case is, OPP officers are still less likely to show in court.
if an officer does not show in court, your ticket is thrown out, as long as you are there.
if you do not send the ticket back in you will be assigned a court date, but because you didnt send in your ticket you will not be told of when this court date is… it will be assigned and if you do not show up then you are convicted whether the officer shows up or not.
i am not suggesting that you fight the ticket and then go to court.
i am suggestiing that you get the court date so that at least you know when it is. That way you have the option of going and fighting it if you decide it makes sense to do so. the only costs involved are a $0.50 stamp and an envelope.
after you get your court date you can send various requests to stick it to the system. You can file for relocation of trial due to your distance… you can also file for disclosure (officer’s notes)…
i do this, not because i want the officer’s note, but becuase it takes 5 minutes to do and wastes like a half hour of clerical time on their part… fuck them, if they dont like it dont write bad tickets you cock sucking faggot faces.
anyways… if you dont get disclosure, or even if you do, you call or write in a few weeks in advance of yor court date and say… “bitch, i didnt get disclosure, i cannot fight this ticket… plus i have some money on an illegal dog-fight on the court date so i cant make it”
with a valid reason like that the court date gets pushed out again. In toronto it is approximately 13 months each time, in Niagara about 6 months, in St. thomas, probably only 4 months or so… fact is… it costs them money so do it.
every region handles the proceedings differently in Ontario… all of them are more fair than buffalo… i know this because i once tried to fight a ticket in bufffalo, you guys might as well live in a communist society holy fuck…
anyways, in Niagara when you fight you meet before hand with the prosecutor. he/she (either or both who knows) pleas it down… eg. i had a speeding ticket of 25 over, she offered me 15 over if i just left… i told her to fuck her hat and fought it anyways…
chances are if you were nice to the officer or if you are polite when you go to fight it that you will at least get it reduced.
all this 6 month suspension mumbo-jumbo sounds like bullshit to me… if you dont have an Ontario license how the hell can they suspend it? and why for only 6 months? the ticket doesnt expire after 6 months.

just mail in the shit, get the court date, mess with them and see what happens.
maybe it makes sense to drive out there for the court date if you can tie it into a few other things.
the worst that happens is that you learn about the system.
I had a 50+ year old woman in my office get a basic traffic ticket, she was crying over it… i told her to STFU and do what i just told you to do… she did, reluctantly, had the ticket thrown out and learned a ton in the process… win win.
