Radar Detector ticket in CA?

So I got pulled over tonight for going 111 in 100 in CA (taking it slow since I saw a bunch of cop activity). I pull my radar down and stick it under my seat before being pulled over and wait for the officer.
He said I pulled you over for “a little speeding”. I said ok and he asked for insurance and reg. It took a minute or two to find since I haven’t driven the car in a while.
He flashes the light inside my car and on my dash and then he points to the suction cup marks on the windshield and asks for the radar detector. He said he will search the car if I don’t produce it. I hand over the V1 and he walks back to the car.
He came back with a $170 dollar ticket and 3 points for the detector, which he said transfers to MI.
He said he wouldn’t give me a ticket for speeding since I was cooperative.

I’m fine with the $170 for the ticket and losing detector, I got caught and mark it up as a learning experience. But the 3 points got me worried.
Anyone know for certain if this transfers as a moving or non-moving violation? (any websites people know of?)

canada?

yeah

is not going to transfer,I got a few tickes there and never got transfer

well good luck because yes they do to NEWYORK and i have the dmv abstract to prove it

OOOOO that sux.
Dam suction cups.
Good luck with the whole ordeal.

I guess I am more concerned with the moving or non-moving aspect of it.

By the way, laser and on/off radar was being used. I saw 12 cops tonight. Watch yourselves going to and from NY to MI.

my tickets are like 2years old and never got a problem

I didn’t think you got points for a radar detector ticket. My father got caught using his X50 in Ontario, they took the detector and he got a $200something ticket, but no points. This was also about 4 years ago.

I got pulled over for 126 in a 100 coming home from Detroit on the 401 (got me with laser). I wasn’t using my detector after my dad’s mess, but still had the suction cups on the windshield. The cop saw them and said hand over the detector or he’d search my car with probable cause. I gave it to him, said I wasn’t using it, the detector was cold since it was in the glovebox. Cop was very cool said, “OK, it’s still cold, you weren’t lying.” Gave me back my detector, gave me a warning for going 26 over and then proceeded to bullshit with me about the Detroit Autoshow (since I was coming back from there when he asked). Totally got lucky as I probably was looking at $500+ for everything he could have given me.

FYI cop said even possessing a radar detector in the car is illegal and he could have given me a ticket for it and confiscated mine even for not having it on. Never actually looked up the law to see if that was the case though.

wow… losing a 350 dollar v1 plus a 170 dollar ticket and points! I feel your pain… for only going 11 KMH over!

Radar detector detectors

“their new spectre3 radar detector detectors will alert a an officer that their is a radar detector nearby and can fine tune to figure out where… There are atleast 85 OPP cars that I know of in ontario that have them that was a year or two ago… remember detectors emit detectable frequency leakage in their operation, ocilisoscopes. This is detectable with these newer guns.”

Also the law says it is illegal to not only use it but also to just have one:

HTA 79 (2)
Speed measuring warning device prohibited

(2) No person shall drive on a highway a motor vehicle that is equipped with or that carries or contains a speed measuring warning device. 1996, c. 33, s. 12.

i had my passport taken away and a 175 in canada. i never paid the ticket and nothing ever happened but that was 5 years ago.

I have a hard time believing it can transfer over with points since the detector isn’t illegal in MI. To put points on they have to be tied to an offense right? Speeding sure, because it’s illegal in both Ontario and MI, but radar I don’t see happening.

And I heard Ontario was really cracking down on speeding but 11 km/h is fucking ridiculous. I miss the old days of going to the detroit auto show with the cruise set at 95 mph most of the way there.

I always take my radar down when I’m in Canada. I had one taken away about 10 years ago up there but I usually have the detector in my side compartment.

I guess I will start carrying a piece of shit radar with me from now on. I would rather hand that over then my V1…

That’s how my dad got caught with his. A radar detector detector. He called Escort to bitch as the X50 is supposedly VG2 immune, etc. They basically said “Sorry, technology is always changing, apparently there’s a better detector out there now we haven’t figured out yet, but we’ll give you $50 off a new unit if you want.”

In NYS if you get a ticket in canada the points go on your license, BUT they are not counted towards your points…I had 16 points on my license at one time but still had a valid drivers license. My lawyers explained this fact to me. The prosecustion and judge can just see it but not hold it against you.

Well hopefully this won’t make it to my insurance company that is all im really worried about.

thats a good idea!
I have an old whistler that barley works. I’d be so pissed if they took my V1!
Glad I saw this, I thought that as long as you don’t have the radar detector on you’re good. guess not

Don’t argue with him on this subject :hang:
