Car Deposit Refundable?

So in short, I placed a deposit on a vehicle from a Nissan Dealership and within a few hours saw an AD showing it for $1000 less than the price they told me.

After thinking it through and the bad experience if I had no have found this AD, their ethical practices of charging me $1000 more than what is posted bothered me. They did want to honour that price but just didn’t have that positive buying experience along with other factors as well changed my mind.

I called the sales manager within 24hrs of the deal and notified him that I am no longer interested because of certain reasons and would like my deposit back.

No word, so I called the sales rep that helped me and he told me it’s ok, the deal is cancelled. I called him twice to confirm and he said it was ok, I even offered to come in to finalize it and he said no need to. He said “I don’t see why there would be a problem getting you a full refund.”

Today, I receive a call from the sales manager saying I HAVE TO BUY THE CAR, you signed the contract.

Now, If I want to back away from it, I do realize they can be compensated for “damages”. I put $1000 down, what type of damages could happen here?

He also said he can take me to small claims to FORCE me to buy the car…never heard of that one before.

What are my options here???

deposits are none refundable. Although when buying a car a 15% deposit is needed. Unfortunitely i dont think you can get that money back. Hopefully Chad can help you out.

I was a car salesman and you dont know what you are talking about in regards to a deposit at a dealer. When buying a car 15% is not needed!! All you have to do is write a letter stating you need your deposit back dude to hardships. Since they havent put the car in your name they havent processed the paper work as yet. IF they still give you a hard time after that, get BBB involved. They will give the money back. LEGALLY there was NO damages done and they cannot put force you to buy a car you dont want to buy. DONT SIGN anymore papers!! call me and I will explain it better than online.

i dont know if this will help. but i was in this same situation, and all i did to get out of it was write a letter saying that the insurance was too much for me to be able to afford at the moment.

Mention the word lawyer in your next convo, they look at you like a young kid, and trying to rape like insurance company would.

Got some good advice from Junior and I’ll hand them the letter tomorrow and we’ll see what happens.

I also work at a dealership and we have deals go south and refund deposits on a regular basis. This clown is blowing smoke up Your ass and probably is under pressure to move that car.

You are not legally tied to that vehicle, You have a certain amount of time to pass the sale and recieve your deposit back.

if they still giving you a hard time, Ill go with you to visit them… and they will not BS me!

I told them less than 24hrs after signing the contract that I was not interested and they got back to me today. Would they count all the days it took them to get back to me as “damages”?

What if they say they put money into the vehicle to have it ready for me, even though I told them before 24hrs. Would that hold any substance?

Hey, you told them before work was done… even still you are entitled to 100% of your money back

You have nothing to worry about dont give in and whatever you do don’t take the car off the lot. There is some thirty day clause as well that is enforced by the government. It should not come to this though as some one mentioned just bring up the word lawyer.

I’am pretty sure it depends on what you signed…the last dealership I worked out had some pretty sketchy forms for people…so fucked they actually would beat you in court because of what you signed with them.

I read this thread last night… wow just wow… I really hope you get your money back. That’s just disgusting and pathetic :-/

Little update, just sent in the letter by hand, as copied from the OMVIC site.

He still insists I’m bound to it and they will be sending me a letter.

I guess we’ll see what happens.

I will be contacting OMVIC and updating them on the situation as well.
