Closing Gitmo: Yay or Nay?

Except they are not considered POW’s. Then international law would apply.

:bigclap: not a bad idea, really.

yup

since they don’t wear a uniform, they’re not considered enemy combatants AFAIK.

Honestly its not like anyone here has suggested to let them go. We all want them to be punished. I just want it to be done right.

All the ones who are guilty, anyway. I’m just concerned that they get a fair, public trial. Not necessarily in the U.S. court system, just in an accessible way to make sure that our justice is… just. If they’re all guilty, they should all be convicted easily, and I’ll be satisfied. The only reason to hold them without trial is if they cannot be proven guilty, in which case… why are we holding them!?

E: Obviously, secret sources such as undercover spies should not be outed by such public trials, but a method already exists for presenting that information.

then why even close the prison in the first place? It’s all political

I honestly doubt that any of these people will ever be truely punnished. More or less they’d be detained, info extracted and then released when they’re not needed anymore. I imagine that more than a few of the guys who went through gitmo are now on our payroll for information.

You don’t think 7 years (and counting) of imprisonment is punishment?

who’s been there for 7 years?

:lol:

All the people there really only had a few options…but stuck on the base…or be blown up or shot…

They started imprisoning people soon after 9/11. I can’t find a list indicating precise terms, but I found articles about people who were there for over 5 years.

This is an older Article, but it has been verified to be accurate and it a very good read.

Cliffs: Article was done by Two United States Attorneys Based only on DoD information regarding the prisoners at Gitmo.

  1. Fifty-five percent (55%) of the detainees are not determined to have committed any
    hostile acts against the United States or its coalition allies.
  2. Only 8% of the detainees were characterized as al Qaeda fighters. Of the remaining
    detainees, 40% have no definitive connection with al Qaeda at all and 18% are have no definitive
    affiliation with either al Qaeda or the Taliban.
  3. The Government has detained numerous persons based on mere affiliations with a
    large number of groups that in fact, are not on the Department of Homeland Security terrorist
    watchlist. Moreover, the nexus between such a detainee and such organizations varies considerably.
    Eight percent are detained because they are deemed “fighters for;” 30% considered “members of;” a
    large majority – 60% – are detained merely because they are “associated with” a group or groups the
    Government asserts are terrorist organizations. For 2% of the prisoners their nexus to any terrorist
    group is unidentified.
  4. Only 5% of the detainees were captured by United States forces. 86% of the
    detainees were arrested by either Pakistan or the Northern Alliance and turned over to United States
    custody.
    This 86% of the detainees captured by Pakistan or the Northern Alliance were handed over to the
    United States at a time in which the United States offered large bounties for capture of suspected
    enemies.
  5. Finally, the population of persons deemed not to be enemy combatants – mostly
    Uighers – are in fact accused of more serious allegations than a great many persons still deemed to
    be enemy combatants.

But hey, they’re not my family, so if imprisoning innocents for the better part of a decade in a foreign land and subjecting them to torture keeps my family a little bit safer, awesome, right?

Despicable, dishonorable, weak.

“From bondage to spiritual faith;
from spiritual faith to great courage;
from courage to liberty;
from liberty to abundance;
from abundance to selfishness;
from selfishness to apathy;
from apathy to dependence;
from dependency back again into bondage.”

I’d prefer to not finish the cycle…

I think we’re seeing a cycle of selfishness, apathy, and dependence. Ugh.

As LZ said, these are not our neighbors and friends being dragged away in the middle of the night. They are there for a reason.

Then they should be charged and sentenced end of story.

Why are you against justice being sentenced out?

You’ve already been put in place, but as the report by US attorneys indicated, there are a lot of innocents there. By “not our neighbors,” do you mean “minorities from other countries,” and that we should therefore not be concerned? If they’re there for a reason, if there is suitable evidence to rob someone of their freedom, then there is suitable evidence to have a trial and go through proper avenues.

Whether or not we are dealing with our citizens, this type of cloak and dagger pseudo-justice is unacceptable behavior for a society founded on idea that it is self-evident that all men are created equal, and endowed by their creator with certain inalienable rights among which are life, liberty, and the pursuit of happiness. It’s our founding doctrine. It’s our mission statement.

We need to do better. If they can be proven guilty, we should do it, not just throw them in a hole, cover our ears, and yell “TERRORISTS” every time someone questions it.

Punished right? Imagine yourself being captured and taken hostage (POW if you will) what do you think they are going to do to you. Offer you medical care? food, water? a nice place to stay? Fuck no. You will be tortured and Killed, maybe even be on video. The people in Gitmo are being treated better than any prisoner that they have ever taken. What was their reasoning for taking our people, NOTHING.

I don’t know why you are expecting the US to give these people great rights when they won’t even respect our people. I know my mother taught me, “Treat others and you wish to be treated”

Also:

I think we should suspend rules of engagement, and Most Laws
against humanity during this conflict.

Publicly announce that you will be shot if you are holding a weapon. Remove weapons from the hands of all their civilians (Give them back after the conflict, aside from a few types… IE I don’t see the point in a civilian possessing an RPG)

This conflict will end really quick.

Charged and sentenced… why… Intelligence is time sensitive, charging someone and sentencing them takes time/money. grab them, and get intelligence out of them ASAP.

What are you going to charge them with… conspiracy and a jury of their peers… Come on, wake up.
