Dealer has customer arrested for paying to low of a price

A Virginia man spent four hours in jail after purchasing a Chevrolet Traverse from Priority Chevrolet in Chesapeake, VA. The dealer’s sales staff accidentally sold the SUV to Danny Sawyer for $5,600 less than they should have, and when Sawyer refused to sign a new, more expensive contract for the correct amount, the dealership called the local police alleging the buyer had stolen the vehicle. Law enforcement then picked Sawyer up and held him for four hours before getting the situation straight.

Dennis Ellmer, president of Priority Chevrolet, says he owes Sawyer an apology on behalf of the dealership, and had intended to do right by the buyer by letting him have the vehicle at the agreed-upon price. But Sawyer’s lawyer says it’s a little too late for saying, ‘sorry.’ The briefly-incarcerated owner has filed two lawsuits against the dealer, accusing the business of malicious prosecution, slander, defamation and abuse of process. All told, the suits seek a total of $2.2 million in damages, plus attorney fees.

That $5,600 seems awfully cheap now.

The lawsuit says Sawyer originally purchased a blue Traverse on May 7, but took the SUV back the next day for a black one. The dealer’s sales manager made the swap, allegedly without saying anything about a price differential between the two. Either way, Sawyer signed a final contract for around $34,000 when the vehicle he took home had an actual price of closer to $39,000. On June 15, Sawyer was taken into custody by police, but the Commonwealth dropped the charges after finding insufficient evidence to pursue the case.

Amazing on so many sad levels…gotta love this country…

You feel for the guy until you see he wants 2.2 million dollars. Give me a break, it was 4 freaking hours not 4 years.

He was arrested and detained unlawfully. 2.2 million is not that much after the time he will have to invest in court and a lawyer.

I just want to see the dealer get screwed for having him arrested for their screw up… that just not cool and there can be no mistake here.

No way will court fees and lawyering be that much. Any time anyone is more than minorly inconvenienced they see fucking dollar signs…

Anthony Capozzi was wrongfully imprisoned for 22 FUCKING YEARS and got 4.25 million.

To me it is not the inconvenience of it. It is the arrogance of the dealership. I don’t care if the money goes to the guy or to a charity, I want to see the dealership take a hit for their blatant disregard of the law and this mans rights. Does it suck that they signed the contract? Sure, but that does not mean that they can retaliate in this manner. I have made contractual mistakes that have cost much larger sums of money and I would have never thought of attacking the customer for my error.

Yes, it’s a bit much, but I agree the dealership should be forced to bend over and take it. They royally fucked this situation up and to me I hope the guy wins over principal more than anything. The dealership sent the man to JAIL over thier paperwork error, lol.

Has nothing to do with being detained in a sense. The allegations in the lawsuit are about his character and the abuse of the police system. You can’t just say somebody stole something and have them falsely arrested without repercussions.
