Are we talking about the first fence with the gate? It’s like touching your house. I would spray paint it a strange color just to LOL when he sees it. If its on your property clearly you can paint it any color you want.
I wouldn’t give in, surveys arnt cheap. I also wouldn’t pay half, I tell him to pound salt specially for the trouble he’s causing you for your pool.

I’d make sure that nice concrete sidewalk and any of his landscaping wasn’t on or to close to my property either… Of course I’m sure you’d hate for him to have to bust up his concrete sidewalk to move it over 6" to get it off of the easement to your property, or risk killing expensive landscaping plants by transplanting them to another location so as not to have them overhanging onto your lawn… At the end of the day, if this guy wants to see how bad shit stinks though, show him

On a more serious note, I’m trying to get in touch with some friends who supposedly know people (Let’s see what good that does) in regards to keeping my pool.
Basically with the fence … I just wanted him to continue the tall vinyl all the way down, and then connect it to the gate (Instead of ending the tall vinyl, and then have the fence go to my house [WTF?]:Idiots). I originally wasn’t making a big stink that he encrouched like 6" onto my property, because he was paying for the whole fence. Then he decided to put that stupid gate up that is touching my house, and that’s when it all went downhill. He continues to claim that his property is like 5" from my house. :eek3 … :crackup
I’ll be going to the town hall tomorrow to hopefully get a plot plan. I really don’t want to pay for a survey, but if he’s trying to make me loose/spend thousands with this whole pool thing for no good reason, then I’ll milk him for every penny I can. If that means I have to pay for a survey to prove him wrong, and rip up the whole fence (Which I believe was close to $2k to put in just down our property line) … well, let’s hope it doesn’t come down to it.
I just wanted him to fix the damn fence and leave me alone. This is unbelievably ridiculous.

I’m pretty sure that Rotterdam requires a fence permit and to get one you have to have a survey done. If he didn’t he’s not following code. Go remove both fences and tell him to get a survey and stay off your property.

You pretty much need a permit to do anything. Since this asshole went out of his way about your pool you need to look into whether or not he got a permit to put the fence up.
if you complain enough you can get whatever you want done… my grand father refused to paint a building he owns because of a neighbor who just moved in, and was threatened with being arrested if he didn’t comply in Rotterdam.

Its without a doubt on your property, for fucks sake its basically touching your house… Is that his house to the left or is that a pool shed? Looks like you guys are in close proximity, i’d laugh if someone fucked up and he was more on your property than he thought (The concrete walkway etc)

Unless you have two benchmarks…you can’t possibly know (within a couple feet) where your property lines are.
When you are discussing a matter of 5" with your neighbor…guessing or walking an imaginary line isn’t going to work.
I’m not saying you NEED a survey. Im saying that guessing property lines isn’t something that will hold up in court when you cut down his fence, OR PAINT IT FLUORESCENT ORANGE!!
