Pretty simple. Apply for permit, go thru the process. Permit will be denied, but fill it out, its the process, then seek variance. It will likely be granted. Explain the complete story only to the board when seeking the variance.

i think he needs a easement to put a fence on your land. but if your land is behind the fence you have to have access to it.
if he has a easement his fence is legal. there are a few different types of easements too. some are assumed and require no documents signed.
this type of stuff reminds me of this guy. real estate is full of weird laws and terms. this guy below shows how weired the laws can get.
