Evo 9 Tech suggestions about warranty

So heres my dilemma, I have been having 5th Gear syncro issues since last August.
After 50mph shifting into 5th I get a light grinding noise but shifts into gear with no problem, it has become more of an issue as miles go by.

I needed a new clutch after 13,000 miles
Called dealership to see if they would cover the clutch and they said no. I asked if installing an after market clutch would in anyway shape or form void my transmission warranty (just to be safe). The answer was “NO” I also told them about the 5th gear problem and that I would be back after aftermarket clutch was install and broken in.

I made an appointment last week and had one of their techs drive the car tuesday. They deff. felt the problem.

Now here comes the part that I need suggestions on.

Manager from Ray Laks service dept calls me back and says they spoke to their District Manager and they will tear the tranny down and check for defects but if there is any indication of “abuse” It wont be covered and I’ll have to pay for the labor if i dont decide to get it fixed at cost to me.
The manager says to me “seeing that the clutch was replaced at such low mileage, we have to say its abuse related; this is Mitsubishi’s policy” My response was “its a fucking an Evo dude, wtf do you mean by abuse? What happend to 10 year/100,000 mile drivetrain warranty?” No response was made by this guy.

The Evo
06 Evo 9 with some mods, nothing major to void drivetrain warranty (not listing mods at this time)

Replaced stock clutch with Exedy triple HD

Should I take it in and risk them saying its abuse, I would be taking them to court at this point for a long battle

Seeing money is not what i have at this point in time I would really not like having to spend any. I honestly think that there is a defect in the gearing not caused by my daily driven “abuse”

Suggestions are appreciated

How in depth did you get with the manager at Ray Laks and the district manager in regards to modding and the warranty? Did you find out what kind of “major” mods would void the drivetrain warranty?

Well he’s a douche bag like any other service manager trying to protect the interests of the company. I just said to him If a mod will cause an issue with the warranty on a $33K car i will not be doing it. I need to be 100% sure that it will not; I have and will always call your service dept to make sure. The thing thats gonna piss me off if they say they wont fix it, is the fact that the car was stock when this problem occurred.
I was snooping around after they test drove the car and heard the manager say “the cars modded, no way in hell is this our responsibility; but i have to check with the DSM to make sure.” When i talked to the service manager at the desk i flat out said u can say what you want about the after market clutch voiding the warranty but you better be prepared to have a diagram proving this in court. He agreed on my statement

They already have, saying the throw out bearing was fucked on the new clutch…the old clutch shouldnt have went already. I am prepared for them to feed me a line of bullshit about this. They cannot get around the fact that 2 months after i bought the car this problem started happening. Not saying i am a pro at manual shifting and this is my second manual car but I am a quick learner and rev match/ blip/ heal-toe is something I use day in and day out down shifting the car…theres no way around it now with the new clutch.

did you f up 5th gear or did the car?

haha… all i can remember was shifting into 5th…down shifted…stopped car…shift 1st, 2nd , 3rd, 4th and then i felt problem with 5th

Was slipping bad, I didnt do much launching…maybe just a few times over the summer

i have 20k on my car and im still on oem clutch.

the thing is. if its your fault, they will prove it, somehow. talk to your evo boi’s and see how they wheel and deal with the service tech’s.

if they said “this car is modded…” what mods do you have?

also in regards to you “take you to court” i highly doubt they will go that far.

won’t your “mods” void the drive line warranty? When I decided to go with my mods I gave up my warranty. I know you only have a pipe and tune, but they are mods I assume would void a drive line.

I have a suggestion though!

How subjective is “abuse” in a transmission???

Can you sit down with a tech and manager and write up a little list of signs of “abuse” BEFORE they work on it. I’m not mechanic, but i’m sure that they are looking for certain signs…that will at least narrow them down and not let them make shit up after your ride is in pieces. I went in about some strange noises in my tranny, they told me the same thing and it scared me off! I just turn up the radio :slight_smile: …not really.

I just got off the phone with the manager once again and he knows the car is modded but doesnt care what mods have been done at this particular point; except anything having to do with the transmission. According to him the syncro’s are under warranty (which is the issue i am having) but if there is any indication that the gearing has been affected in anyway this constitutes as abusive and will not be covered… fyi

stock evo clutches are HORRID. the only way they will last is if u drive like a baby

22k stock clutch. 25psi all day long, city driving. for the last 12k I haven’t gotten better then 16mpg because of my driving. and still grabs like a champ.
If you blow your stock clutch at 13k you either beat the shit out of it or there was a serious defect.

I beat the living crap out of Jeller’s car all the time (I think he does too), and he’s around 40K on the stock clutch.

I think unless you are doing dead digs all the time, that clutch should not wear out at 13K

Jared uses the car no doubt, but he has a 9 with full exhaust, fuel pump and a proper tune. I guarantee it’s making a ton more torque than your car. I couldn’t finish the tune the first time because the stock clutch couldn’t hold when the torque hit. It was well worn but it worked fine with the boost at stock levels. :wink:

It sucks but I have to admit this is hillarious. They hear the typical multiplate clutch noise and they think it’s a bad TO bearing. LOL :smiley:
