Filling a formal complaint for traffic stop?

I know, but at that point I was just frustrated with all the BS.

It was redicilous to me at the time that the 3 dudes had badges and were acting like this and I could not do anything about it. :tif:

Police are not above the law and have no right to lie/ticket because they were “disrespected” for being pricks in the first place or not called “sir”. They will continue to do so with submissive dolts like you who don’t stand up for themselves. I’m not saying to start throwing out names but your additude is shall I say… :hay:

Negative. I’m not saying be submissive, I’m saying to defend yourself in a respectful manner. If you can’t do it on the spot, do it in court where they WILL listen. Like you said, they power trip sometimes. Don’t give them ammunition or encourage it.

ok, while the cops may have been assholes what was done was still wrong. You cannot tailgate even if they are going 10mph and you cannot cross a double line to pass even if you only cross it by 2in. It doesnt matter if there waving you by or not, if you need to cross a double yellow your breaking the law. Its shitty and even though the cops were assholes they still gave you legit tickets.

I spent a couple nights in erie county holding from BS wreckless driving charges as well but they were all dropped in court after i explained the situation. I guess this is somthing you could chalk up to bad luck. Just be more careful and suspicious if something similar happens again in the future.

I have my iphoner set up to microphone anything importaint that happens… Usually turn it on whenever I feel it may benefit myself.

not many police agencies in this area have cameras in their cars. (i know east aurora has had them for a while, but i don’t know who else does. i don’t really make a point of finding out, just thought i’d add that.)

Brooklyn: at what point did you know the car was undercover? Only thing I can think of is fight it in court due to the fact you seen it was police and they were waving you on and that you assumed they were giving you the OK to pass. I know the law says no passing on double yellow…but if its police saying “yeah its ok, go ahead” that kinda makes this a little different.

Sorry, did not want to post without updates. I never passed them illegally, they went over double yellow to let me pass then accused me of doing multiple wrong things. When I passed them I passed them without breaking any rules.

I have filled internal affairs complain, did not hear back from them I assume because my case is still pending.

Got a lawyer who charged me $500 for this case and court date is this Wends day.

If this is dropped, I’m planning on getting a lawyer and suing police officer that shows up in court/wrote actual ticket for all lawyer fees, fines (if any) and stress.

I will post my internal affairs complain shortly.

This is a formal complaint against three officers that pulled me over on Saturday August 23rd 2009.

I would like to make a strong note; that this is NOT an attempt to get out of the issued ticket as this matter will be handled separately.

This is rather an attempt to describe completely unprofessional actions of officers in the line of duty.

As I was on my way to pick up a friend of mine around 10:00PM EST time, I approached an unmarked patrol car which was traveling well below speed limit and in my opinion creating a dangerous driving condition at that point.

Since I could not use another lane to pass the car in question; I gave a very
brief and friendly short honk to let driver of the vehicle know that there is a car behind them.

Right after the honk, I observed a service red white and blue lights flashing in the car. At this point it was clear to me that the car was an undercover vehicle on a patrol.

They let me pass, which I did (at no point did I exceed speed limit/break any sort of
driving laws) and then as I passed they pulled me over.

Officers approached my vehicle; and asked me why did I honk at them. I calmly and clearly explained that I was not aware they were an undercover unit and was being polite by giving a brief honk. I followed by explaining that I was taught that driving severely under speed limit created hazardous driving environment. I also apologized.

At this point all 3 officers appeared to be smirking at me; followed by un-called and FALSE accusations
of but not limited to:

  1. Passing double yellow line to aggressively pass their vehicle
  2. Tail gating
  3. That I was speeding when I was behind them

Then another officer suggested that I was drunk, which prompted all other officers jump
on this idea and smile at each other.

I started to get worried as multiple attempts to bring up false charges were made and
accusing me of being drunk seemed a little scary to me; as it was clear that officers were
trying to get something/anything to stick at this point.

Another unit pulled up and I was addressed a breathalyzer test; which did not record any alcohol level in my system after two attempts.

At this point three officers that pulled me over looked upset and started making claims that
my registration is invalid followed by claim that my insurance is also invalid (both false).

Newly arrived officer dismissed their claims and ordered me to enter my vehicle as he departed
the scene.

For the next 15 minutes I observed three officers in their squad car laughing and at the end
I was presented with a reckless driving ticket, which to my understanding carries up to
6 points, $600 fine and possible criminal record.

All of the above for simply giving a friendly honk to another vehicle which is traveling
well under legal speed limit?

I don’t think individuals that tried to stick random charges on someone because they were
honked at should be in power to make any decisions; especially when it comes to serious
responsibilities that police officers take upon them self’s.

While this complaint will probably be ignored, I have had pleasure of dealing with
police officers from my previous experiences but officers that pulled me over should
not have a honor to wear a badge.

I felt like I was back in high school during the stop and I feel very frustrated that
individuals in question were abusing their power over something so ridiculous.

I’m curious where this goes. i hope you sent a copy to the DA’s office.
I’m thinkin this was a wrong place wrong time situation and wont go anywhere. I have had past complaints agaist our (erie County) DA’s office that i wanted to pursue and could find no one willing to listen including state AG’s office its as if they are above the law, not that they should be. what comes around goes around, my stink involves someone from the DA’s office that in the paper daily (asshole!)

Yeah, unless you get beat on TV these cases are really ignored by internal affairs. I’m just waiting for next week, if this is dropped I’m going to drop a few $$$ to sue that cop personally.

Not sure how it works as I still need to talk to another lawyer but maybe I can get him to come to court late on Fridays for a month straight that would be sweet.
