Got Rear-ended today on main st right in front of towne BMW…
I was stopped, he hit me… Scraped up my rear bumper pretty good and bent my muffler so its now done for…
Called the cops, sheriff showed up… got the police report in hand…
My question is, what do i need to do next? do i have to go get estimates for the damage… and call his insurance company and go from there?
obviously im not on the hook for any sort of deductibles correct?
My muffler is done for, and its aftermarket… am i going to have a hard time getting them to replace that with a new one? (its going to be expensive)
I was just in an accident. I called my carrier and let them deal with the other persons insurance. I am not sure if you should call his or your as I was at fault in mine. They sent someone the next day, wrote what I knew was a fair estimate, cut a check and left. I then took care of it from there. If there is a loan on the car they will want to send it to either your bank or the shop doing the repair. You might want to just call the other persons ins and they will send a claim adjuster? But I would be afraid they would try to skimp. As far as the muffler they will be writing for an oem one which i am sure is quite a bit of coin and will cover it.
My parts they wrote me for were actually a little more expensive then real OEM said. So looks like you will get a solid chuck of change for that muffler.
Can it be cut and rewelded? You might have to go that route. Id ASSUME a good fab shop with a $950 budget could make your current exhaust good as new again.
Don’t worry about the bumper the insurance will cover that stuff no problem. You will probably not get $3300 for two mufflers haha but I think it is more then fair to take the $950+labor you will get and have yours repaired which I am sure you will be able to do. Hell you will probably have that fixed and pocket $800 so I don’t see it as an issue.
Edit- I see you dont think it can be repaired. Well I don’t know you might have to start looking for a used set.
Replacement value… I cant buy them again for that price readily… So isnt their insurance company required to get my car back to the way it was when he hit it??
Doesn’t your neck hurt? I think you said your neck hurt, you should get that checked out. It could be whiplash, or worse. It could inhibit you from being as mobile as you were before the accident. Your neck hurts right?
have it taken in to a shop and the bumper taken off. My car looked like nothing was done to the rear besides a scuff in the bumper but it really bent the shit out of the rebar and even pushed the floor/rail in a little.
call your insurance company. they will probably pay for it then go after the other guys insurance them selves especially since you were at a dead stop. go to the doctors within the next day or two to get checked out. my neck was a little sore from the whip lash the next morning. I was told to get x-rays just to cover my ass in the future and I got to go to the chiro 3-4x because it was still sore a week after. and I am not one to call bs just because i was rear ended.
about the muffler, when I worked at the body shop I remember adjusters looking around to find non-oem parts to replace them with what was on before. so its definitely worth the fight.
you should make out with 4-5 grand. in pocket. your bumper is cracked. get a new one. possibly have them write to blend the quarters and maybe deck lid because its metallic (you dont actually have to get that done, btw, just get it paid for). i would not be surprised if the rebar is smashed too (its carbon fiber on m3’s, possibly yours too) along with the bumper shock absorbers. probably didnt to any damage to the rear body panel bc of the absorbers.
take it to any body shop you know and get the bumper taken off, hopefully you know the people doing the estimating so they write it ‘good’.

p/s you should have called your ins co right away. I had the check from geico 2 days after the accident (well it was the soonest I could get in for an appt, got the check that same hour)
Deal with your insurance company first. Make them aware of the accident and then get a quote, most insurance companies have a 24/7 phone line to make a claim. See if you can get a reciept for the exhaust (maybe a photocopy from another exhaust owner). Then follow their directions on what to do.
definitely contact your insurance company. give them a copy of the police report and they will handle it from there. This is why you pay them. They represent your cars. If the amounts the other insurer gives you are unfair you may be able to contact your company to compare estimates to ensure that they are handling the claim fairly.
It’s not gonna do any good to get an estimate for damage. Most major insurance companies don’t go by shop’s estimates, they pay out based on what THEIR adjuster sees wrong with the car. From there, they will cut you a check for the damages and give you some paperwork stating what the shops should fix. If the shop you take it to feels that it was not estimated correctly by the adjuster, then you should let the shop call and argue that they need more money to fix the car.
i am currently going through the person’s that hit me insurance. This is exactly how it happened. The adjuster looked at it for about 15 seconds and made the estimate, then i got a check for that amount. I called my insurance company because it seemed sketch to me, and they said that i can take it anywhere i want to get fixed, if it’s going to cost more than the estimate, the repair shop will take it up with the insurance company.
sucks about the aftermarket parts though… don’t most insurance companies ask you to notify them of aftermarket parts in case of an event such as this?
I’d imagine that be only if you were at fault and were looking for your own insurance company to cover your aftermarket parts. By you paying more to your insurance company doesn’t make sense towards another insurance company covering your aftermarket parts in a case where their customer is at fault.
