Any advice will be helpful
thanks alot
It means, if the officer doesn’t fill out the an initial fine amount. It’s an invalid ticket.
It means that you should cross reference your ticket fee with “the Ontario court of Justice website…or ask a paralegal” . If the amount indicated on the ticket does not match prescribed rates… its deemed not to be complete.
so if i got a ticket of speeding of 129km in 100km what should my total payable be?
It will say that on the ticket… Total Payable.
thats the whole point of this, if the total payable doesnt match prescribed rates, it is not “complete”, so im trying to find out what the proper charge is
thanks
furthermore is this considered “fatal error” and what happens if i have filed for a court date, how do i go about wininig this case? thanks alot guys
In theory, according to the article you posted, if the total payable is incorrect then the ticket is invalid… I’m not sure how much yours is off by… but you should read that article closely and that might answer your questions, like
“In a 2-1 judgment, the court said an officer’s failure to enter the correct amount in the “set fine” box on a certificate of offence means it is not “complete and regular on its face” and must be quashed by a justice of the peace.” And/ or
"The ruling applies primarily to people who exercise their option to do nothing after being served with an offence notice.
In these cases, after 15 days, a court assumes a defendant doesn’t want to dispute the charge and the matter is left to be dealt with by a justice of the peace."
“That miscalculation resulted in the total amount payable to the court being inflated, sometimes by $5 or $10.”
