So I was in Myrtle Beach this past week with my parents and wonderful gorgeous girlfriend. So about Thursday I get a call from the girl watching our pets. One of the sheriffs from Allegheny county is looking for me. WTF?
After some phone tag with the girl watching our pets I get his number. All it was was a piece of paper with the sheriffs name on it and a number. So I call Friday morning and he tells me there is a piece of paper from Westmoreland county that he has to deliver to me. I asked him what it said. He said
someone is suing me.
Great, I havent been in trouble in a long time. The last major thing I can think of was my accident 2 years ago with my Integra. I rear ended someone, totally my fault. My insurance supposedly took care of it. Yet here I am 2 years later, almost to the day, and I get a piece of paper with a name. I have NO clue what it’s about. So Monday I get to wake up early and call the main office for my insurance since my agent is useless (Erie). I have to call them to see if they can give me some legal help. If not I’ll probably get sued for the health bills this guy has.
Two years is the statute of limitations on suing somebody for that. I was rear-ended and I was told that I had two years to make any claims for damages, after that date I forfeit all rights to sue for damages, lost wages, etc.
However, they should be contacting your insurance company though, not you.
Same thing happened to me and it scared the shit out of me when I opened the door to see a sheriff’s deputy. It is probably a “writ of summons”. The deputy explained that it is essentially a way for them to extend the statute of limitations. I never heard anything about it again after that. You should be fine, it is a technicallity.
yep it was a writ of summons… like I said I called my insurance agent but hes worthless… the police report that was attatched to the case is now gone so I dont know what the name of the guy I hit. Either way my main office is getting called to see if they have a copy. Then I will know for sure what is going on.
Well I checked with my insurance company. Everything is being taken care of… as Huskygrl stated there is a 2yr statute. So they had to file it. My insurance is taking care of everything for me.
Wow, not fun when Johnny Law comes around, esp to your house.
We found out from the neighbors that the IRS was at our door this past winter :ugh: LOL Hubby doesn’t like paying the feds. A check was handed over for $60K (business) the next time they came round tho
lol, my dad felt real bad, he thought I missed some Jury duty information and they were coming for me :ugh2: All I have to do is send them a copy of the Writ of Summons to Eries office and they should handle the rest. My dad kep telling me to cut off my hair and be all presentable in court. I told him there wasnt even a date on it so I am still gonna keep my scruff ball look. :embarassd :booty:
