So last night, I got my brand new bings catback exhaust, which is fucking sick thanks bing and chris.
Around 11 o’clock tonite, I was pulling onto Winston Churchill via the QEW from South Service road by AMC on the boarder of Mississauga and Oakville. So my buddy and I, who has a silver Mazdaspeed protege make the turn onto Winston Churchill, hes in front and is taking my friend home so he waits for me to say bye and were side by side talking. Were side by side for less than 100 meters until to up and coming red light and our cars were doing 4000 - 5000 revs in 2nd gear, mind you we werent even breaking the speed limit at that rate. We get to the red light less than 100 meters later and just as im pulling onto the highway a highway and traffics cop and some emissions pig in some chevy SUV pull me off from going on the highway and pull us over.
The pigs in their bulletproof vests take our papers as usual and open our hoods and inspect our exhausts, we check out perfectly.
So they’re conversing for a good 10 minutes then come to my car and say “Bad news son, you were street racing” and we have a summons to court August 30th.
My question to you is: How can they prove that was street racing as they were stuck at the light behind us, they cannot prove we were speeding as they had no radar, so how can they prove we were racing?
Sure my exhaust is tastefully loud and according to the emissions pig it was fine, is it even possible to race when your 100 meters from a red light?
Our hard earned tax dollars at work people, you cannot talk with your friends side by side in a stock car with rims and a catback without getting summoned to court.
anyway, in order for street racing to occur, there has to be a starting points, a finish line and some sort of a wager. Get yourself a good paralegal and it will be dropped completely.
172. (1) No person shall drive a motor vehicle on a highway in a race or on a bet or wager. R.S.O. 1990, c. H.8, s. 172 (1).
Penalty
(2) Every person who contravenes this section is guilty of an offence and on conviction is liable to a fine of not less than $200 and not more than $1,000 or to imprisonment for a term of not more than six months, or to both, and in addition his or her licence may be suspended for a period of not more than two years. Horse racing on highway
173. No person shall race or drive furiously any horse or other animal on a highway. R.S.O. 1990, c. H.8, s. 173.
what section were you charged with? IE: HTA s. 172 (1)
“race” means a contest of speed between two or more motor vehicles, whether or not the contest involves a prize, when there is an indication of a common intention between the drivers to engage in the contest; (« course »)
Yeah it’s like I said when I posted about ERASE coming back. They’ve been given FULL AUTHORITY under the HTA and are using it! They also seem to be abusing it too but I expected as much.
You guys have to be carefull out there guys as they are fu_king around anymore. Wether the ticket is bogus or not, wether you fight it or not it’s still a royal pain in the ass. So just watch yourselves out there.
I’m sorry to hear what happened and like the others, I’d say fight it for sure. Look through the HTA link I posted up in the ERASE thread and see what exactly your summons is under. There will be full and complete definitions of it. Then go from there.
they gave him a ticket for having a turbo? your fooking kidding me… How friggin clueless are these people?
I’d be like excuse me but this ticket can now be ripped up… yeah… the car came with the turbo so go pull over someone else.
I wonder what will happen when I remove all my emissions for the ka-t… too bad it will run just as clean with out all of it.
lets all just get it tattoed on our asses then we they pull us over and walk up to the window just hang it out the window so they can check for emissions.
