Latest local lawsuit

I respect that cops put their lives on the line everyday, but where does it end. What’s next? A firefighter drives off a snowy road responding to a fire and breaks his arm. Does he now get to sue the home owner for allowing his dog to knock a spacer heater into a pile of newspapers and start the fire? Sue the spacer heater manufacturer for making it? Walmart for selling it? NYSEG for providing the electricity to power the heater?

One main factor that has been ignored here is the location of the officers residence. Lockport. Nuff said.

People just look for any and all reasons to sue there. It’s ingrained in the culture.

While cops do put their lives on the line during their job duties, they also know well ahead of time what they are getting into. They did not get drafted into the force, they choose to take the risk with the rewards that come with the job. The fact that he was driving way to fast and crashed his vehicle is none other then his fault.

Every time a judge even entertains the thought of these types of cases, it just further proves the degradation as a society for not being able to take responsibility for your own actions. The lawyers are at fault here too, but if judges would crack down and keep tossing these types of cases out, the lawyers would stop trying to file them in the first place.

Turn around and sue the cop for mental anguish that was caused by the lawsuit.

Of course he should be allowed to sue. The individuals right to seek justice is one of the fundamentals of a free society. This should go to court, and he should lose quickly.

By the way, it’s not legal for cops to speed. They have to obey all the same laws we do. Just thought I’d mention that.

This is what’s wrong with this country. It’s so engrained in our culture to sue sue sue. Someone else must be held responsible! People can’t comprehend that sometimes life deals you a shitty hand and you have to live with it. He chose the high-risk profession, he chose to drive so fast that he couldn’t control his car responding to a minor call. What if he crashed turning around to pull over a minor speeder? I feel bad for him, but he doesn’t deserve a dime. As for also suing the people who helped him, blame the lawyers for that. They always pressure clients to sue as many people as possible because they have a better chance of a big payout. If you want to sue person A, you also have to sue person B and C. They don’t care if innocent people are bankrupted after they have to pay more lawyers to defend themselves. No matter what they all still get paid.

Gerhardt is a scumbag. No way around it. have lot of family and close friends in that Dept. Used to see him at bars piss drunk then drive home. He would had behind his badge. I am so sick of the poor me attitude from Alan, the fundraisers all the time and donation boxes all over the place.

    The night before he showed his great Driving skills.  I saw Alan at the Burt. A small dive bar across from the Burt dam in Burt NY.  Alan was with some underage girls, the bartender would not serve them. Well Alan being the outstanding guy he is. Pulled out his Badge, then shouted of that he was a cop and it is ok for the underage girls to be served. It turned to an argument and the owner made Alan leave the Bar.  (this is a first hand experience)  He is a fucking scumbag

The call was not an emergency call, He was not supposed to be driving the way he was. I grep up not far from where he crashed. It was a a dip and curve in the road. He is 100% at fualt. in that lawsuit of suing the over the loss of legs, some where his fellow coworkers that were in the Sherrifs car behind him. They even stated he was driving like a retard. Alan was a fucking cowboy who thought he was billy bad ass because he had a badge.

These sorts of lawsuits happen far more frequently then you’d imagine. This won’t likely ever even make it to trial. The insurance company will probably settle way before then.

And we wonder why we have to pay so much for car insurance.
