I got a letter in the mail today, saying “Notice of Driver License or Driving Privilege Suspension”
Suspension date: 5/20/2006
Ticket Number: LN9142534
Reason of Suspension: Failed to Answer Summons
Violation Date: 02/02/2003
Violation: Speed In Zone (52 in 40)
Now, I called the court and I have to send in a plee of guilty/not guilty, 3.5 years later! I asked her why I didnt hear back from them, and she told me I never sent the ticket in. I did, 3 years ago… so, I just figured it was lost, or nothing happened.
SOOOO… my question, what the hell do I do? Points go onto your license and stay for 18 months after the violation date, not the date of judgement. So, if I plee guilty, does this mean I wont get any points?
And, what about the suspension thing? This was friggin 3 years ago!
Advice? I want to get out of this without paying a penny, because… thats bullshit But, I have to do something, or I’ll get my license suspended for something that happened a long time ago.
If thats true, I’ll be pretty pissed. I finally got a clear license, haven’t been pulled over in 2 years… and have been straight and clean.
If I get points, or have to deal with bullshit from something I did so long ago, I cant even remember it… I’ll just throw up my arms and give up. I’ll just go back to driving 120 MPH on the 90, and not using my signal, cutting people off, and driving like an ass-hat.
Go there, plead guilty and pay the fine, no points will be on your license as a result…it’ll still be a factor in your insurance rates though. No matter what you wont get out of it without paying some sort of a fine.
Check your insurance policy, I do not get any points with my insurance company (those last 39 months) for speeding tickets unless it is excessive speeding. Excessive speeding to them is 15mph over the posted speed limit, under 15mph they don’t care.
You would only have the NYS points, which doesn’t matter if you don’t do anything stupid for 18 months
Yeah just go plead guilty and take the insurance hike…even if you did send in the ticket so long ago, It is still your responsibility to follow up if you haven’t heard anything…i learned my lesson on that one
he is right. find a good lawyer that isn’t expensive…they should be able to straighten things out for you so you don’t get owned by the court. good luck!
So, Joe says that there are no points, and the rest of you say there are.
I remember years ago when i was told it was from the date of the ticket, and thats what has stuck in my brain.
So, if I plee guilty, points shouldnt show up because it happened forever ago… and it’ll be a fine, and thats it.
Someone give me a straight answer, and stop guessing.
And that insurance thing… why would my rates go up if there are no points added, and my license is clean? NYS points, and Insurance points? Are you people just making stuff up?
I’m a little confused with Joe’s post as well. It appears to be conflicting info on the DMV site.
I believe this is the right info though:
A moving violation conviction or an accident normally remains on a driver record during the year that the conviction or the accident occurred, and for the following three calendar years. (Note: The DMV uses the year when the conviction occurred, not the year when the violation occurred.)
AKA, the fact that you sent in the ticket and thought it just magically got taken care of by the ticket fairy doesn’t mean anything. It’s found out now, and if you’re convicted you’ll get the points and insurance hike from the date they convict you.
I know for sure that your driving record shows the date of conviction, not the date of the violation, because I have a “Speeding - Vessel” on my record from November 2 years ago. I went through the channel at the end of Grand Island around 15 mph and got owned by the sea pigs. I know for a fact that it didn’t happen in November because we were going wakeboarding that night, and didn’t get to because the cops took so damn long to write the ticket, and it’s way too cold to wakeboard in November. At least Progressive doesn’t count it toward my car insurance.
If you are convicted of a 52mph in the 40mph zone, you will get NYS points (only last 18 months), but if your insurance is like mine, you won’t get insurance points (those last 39 months). I need to be 15mph or more over the posted speed limit to get any points with my insurance company.
NYS and the insurance companys have seperate and different point standards.
Look at your insurance policy, it will tell you how fast you have to be going (if convicted for speeding) to receive any insurance points.

I guess I’ll plee not guilty, and take it to court. And I thought that years ago, when I was pulled over monthly was the last time I’d see the inside of a court room due to my driving! LOL!
NOOOOOOOOOOO…It means it will be on your license that you were convicted…the points go off 18 months after the VIOLATION DATE. Points and record of conviction are not the same…if the violation date is 18 months old or more, you wont get any points on your license, HOWEVER it will be on your record to be seen by insurance, cops, etc…
The information I posted wasn’t confusing at all.
Basically if your insurance doesn’t count anything under 15mph…save time/trouble and just plead guilty…
or if you wanna take the time out so it’s not on your record, go get it reduced.
HOWEVER…NO POINTS WILL BE ADDED TO YOU LICENSE NO MATTER WHAT COURSE OF ACTION YOU TAKE.
