My Paypal claim story

I buy a used fender for the wifes A4 on ebay from a guy in Quebec (prob a bad idea, I know now). It was listed as NO dents, one small rust spot on the front lip near the headlight, and some minor surface rust at the rear under the lower trim.

I get the fender there are two large “dents” in the inner fender lip, bent so much that all of the paint is completely flaked off. Also the small rust spot up front is a huge mess, and the surface rust in the rear is not under the trim.

I contact seller through paypal telling him Im unhappy… no response.

I wait a few days and try to contact him again, no response.

I open a case with paypal and send him the same message, again no response.

I wait until the last day to escalate it to a claim. Paypal takes a week or so to decide in my favor. I then have 10 days to provide them with a tracking number. Still no respose from the seller, not once after almost a month of screwing around with all this. I give them a tracking number on the last day ( mainly b/c I was out of town for almost a week for work) and the fender ships back to canada… $68 bux out of my pocket.

Seller refuses package and sends me this message:


Hey!
JuiZed…! I am coming to you to pickup my fender!
TWO BIG DENTS …???,either that was the fender on your car that you were replacing or it arrived damaged by UPS! If you would have read my BUYER IMPORTANT INFORMATION it would have mentioned ANY CLAIMS BY DAMAGE IN TRANSPORT MUST BE MENTIONED WITHIN 24 HOURS OF PACKAGE DELIVERY.NO WhaT DID YOU DO 10 DAYS LATER START A PAYPAL DISPUTE! NOW I CANNOT CLAIM UPS AND YOU SENT MY FENDER BACK TO ME AS A SHIPMENT NOT A RETURN ,MY COUNTRY CHARGED ME 53.00$ FOR THE FENDER THAT WAS ON YOUR CAR! MY EBAY BUYER IMPORTANT INFORMATION MENTIONS RETURNS MUST BE INDICATED IN PAPER WORK TO ME. YOU TOOK ADVANTAGE OF EBAY ,PAYPAL AND ME!I AM COMING TO PICK IT UP 100% SO DO NOT DISCARD.I WILL DRIVE TO THE USA WITHIN THE NEXT 30 DAYS! I WANT TO SEE MY FENDER IF NOT I WILL SEND YOU A LAWYERS LETTER AND IT BETTER BE MY FENDER I MARKED IT FOR AUTHENTICATION. I DO NOT BELIEVE YOU.


Mind you this guy is coming from Quebec and the fender is already on his door step, but he refuses to pay the duties.

So I basically told him he can either pay the duties and get his fender, or UPS will consider it abandoned and he’ll never get it back.

After all this bs I still feel somewhat bad about the whole thing. If he just would have responded to any of my messages we probably could have worked this out. Ah well, I did it all by the books through paypal, so F him.

Anyway, just thought Id share my only bad experience with ebay/paypal.

It already did work out I guess. I have my money back in my paypal account and paypal considers the case closed. Just sucks it had to come to this.

I hate paypal.

There needs to be a better way.

I got fucked over on paypal too. If the seller sends a tracking number, any number that shows something was delivered to some house. Then there is no talking them into you getting your money back.

Well paypal sided with me and I got my money back.

But this joker is going to be out his fender b/c he was too lazy at first to respond to my complaints and refuses to pay the tax to get his fender back.

I guess I will just wait to hear from his lawyer…

I believe UPS has lot auctions for the stuff like once a year…

so he marked his fender for authentication? does he have PROOF of his authentication ? Does he have pics of the fender he sold ? can he prove his case in any way shape or form?

his attempts to scare you must have you shaking in your panties

so how come he paid the duty but didnt accept the fender ? and now hes gonna spend time and $ driving down here to inspect something that was literally AT HIS DOOR STEP.

he doesnt have a leg to stand on, he agreed to ebays rules and paypals rules when he signed up for those sites, and by failing to respond to the claim you placed through them he automatically looses.

Exactly. I sent him a few messages since that one he sent, all through paypal, all copied to myself, not a single answer. So he must not want his fender back too badly.

Well apparently he wont pay the duties, according to UPS, which is why they wont deliever it. I marked the shipment that the reciever must pay duties (which is exactly how he shipped it to me). UPS gave me three choices: Pay the duties, pay to ship it back to me, or abandon it which costs $0.

So today is the final day he has to pay the duties on the fender to get it back, and I still havent heard anything from him. I responded 4 times to his message though paypal and never a response. I guess he doesnt want his fender back too bad after all.

I guess Ill just wait for his knock on my door, or his lawyers letter. hah
