On a side note: I do more nitrous runs in my C5 by myself not racing anyone, then racing someone. If someone where to run me at a light though I am more then game. If I was to race my vette into a wall while driving by myself, should my family sue the state for putting up a barrier on the highway?

He was involved in an illegal act where people where killed. If he would not have been racing, they still might be alive. No he was not the driver, but he was still part of the reason for the end result.

Then the fucker didnt stop to help just ran home and hid under his bed until Twizted showed up to his house and made him turn himself in! Melanie died on the scene, Mark didnt he could have helped!!! Then he CONTINUES to break the law while facing Manslaughter charges. Im mean WTF you drive a loud bright blue neon and every cop in Lancaster/Depew/Cheektowaga knows exactly what you look like and you dont think you will get caught!!! And when he was INVOLVED in the race, he most certainly is legally required to stop and see what happened, and to call for help if someone that is unable to on their own . It’s called fleeing the scene of an accident. Which is illegal.

Unless you have a special relationship to a victim (family member, employer…) you have no duty to rescue. In fact, if you do begin a rescue you immediately open yourself up to liability if you commit ANY act of negligence during that attempt. Honestly, with civil litigation the way it is you’re better off keeping out. It’s unfortunate, but reality.

I’m not too familiar with crim law yet, but I do know you shouldn’t leave the scene of a fatal accident when you’re also involved in the accident. The problem with this case though is I can’t see what duty he would have to either of the victims. AFAIK he didn’t do anything to cause the accident. Why would he have any obligation to stay on the scene? (besides the moral one…)

you could stop and call 911 AT THE VERY LEAST. Apologize the families on the loved ones and tell them you are deeply sorry for their loss.

You could, but you don’t have to. I would have and I feel it is the right thing to do. However, as witness to an accident you don’t have to do anything. You can stand there and watch if you like.
