So I got a double whammy today in Amherst. Made a right on red from millersport to sheridan when someone on sheridan decided to do a u-turn and the the officer gave me a fail to yield right of way because I didnt pull over until the next side street to turn onto.
Im just curious whats the cost on these violations? Im doing the supporting deposition just so I can actually say something because I relly think the fail to yield violation is just BS.

As I read it, you failed to yield the right of way to the car making the U turn, not because you took your time to pull over.
It’ll be dropped to a parking ticket. I got that in Tonawanda and thats what they did.
Sheridan is two lanes at that intersection.
Wouldn’t the car making the U-turn only have the right of way to the left most lane.
Where as the car making a right on red would only have to yeild to traffic in the right most lane.
Knowing that it is pretty difficult to do a U-turn without venturing into the right lane, should the U-turning driver be ticketed with unsafe lane change?
Hmm if thats the case then Im not that pissed about it then but yea I was at the red light sitting ther for atleast 15 secs until the one car turned left from sheridan onto millersport then i started going which is when the other car behind that car did the u-turn but I stopped when I noticed she was doing it and then she stopped as well mid-way and then waved me to go so I went.
I just found it kinda out of the way to just pull me over for that reason so I expected just a warning since I was working and in my companys vehicle he would cut me a break. When I saw that he wrote “fail to yield right of way” I thought that was for not pulling over immediately but yea if thats just for the right on red then fine but I will still do the sup. depo. to explain the lady waved me to go and better chance to get it reduced to a parking ticket.
There’s no way of making a U turn w/o going into the other lane, hell on NFB I cross all 3 lanes. When you’re at a red light, you have zero right of way when making a right hand turn. You have to yield to everyone in the intersection, so that is a valid ticket. I’m also assuming there was a sign stating “No Turn on Red” if he got a ticket for that as well. So that means he definitely didn’t have the right of way.
Plead not guilty, it’s more than likely you’ll get a parking ticket if you have nothing on your record.

im almost positive the other driver had the right of way considering he had a green light and you had a red light.
regardless of which lane he used, its your responsibility to look before turning.

Taken from the NYS DMV Handbook. Since a U-turn in this situation is a left turn:
The EXACT situation is not outlined, however:
If the road you enter has two lanes, you must turn into its left lane.
Approach the turn with your left wheels as close as possible to the center line. Enter the left lane, to the right of the center line. When traffic permits, you may move out of the left lane.
I can’t see a U-turn at that intersection that wouldn’t require the use of the right lane. While U-turns are legal, straying into the right lane while doing a left turn is not.
^ a U turn has to have different laws than a simple left turn. It’s nearly impossible to start at the turning lane and turn into the left lane in the opposite direction.
When you have a green arrow you have the right of way in the direction of the arrow (90 degree left turn or 180 degree u turn). Nobody else has the right of way and shouldn’t be in the intersection, therefore you should be free to pick any lane.
You may make a U-turn only from the left portion of the lane closest to the centerline of the roadway, never from the right lane. Unless signs tell you otherwise, you may make a U-turn when you are given the go-ahead by a green arrow left-turn traffic signal, provided it is not prohibited and you yield to other traffic.

well since its a divided highway, I’ll bet it had a no turn on red from 8am-6pm or something along those lines. That would probably be the reason you got a ticket for turning right on red.

Yes, you have to yield to other legal traffic, but someone making a right on red does not have the right of way and therefore isn’t legal.

fairgentleman, the u-turning car is not expected to make his u-turn from the turning lane directly into the left most lane of his new intended direction as you asked. he may turn into whichever lane he can/wants. since he has the green light, he has the right of way.
op: you were in the wrong. it had nothing to do with your slow pull over time. you will likely get a parking ticket.
