Seeking advice as only NYspeed can provide

1st thing has to do with Cole Muffler on Walden and Union. They did my GF’s inspection and hand tightened the rear lugs. As a result she lost a lug and was driving around like that for awhile. I get in the car with her (highway no less) and hear the rear wheels wobbling and check only to find the missing lug. I tighten the other lugs and am in absolute shock. I am wondering what approach I would be best to take. I would think write the co. first then deal with DMV watchdogs if they don’t pony up for a new set of lugs and the cost of the inspection. That’s my desired action from them, which I think is QUITE reasonable considering what could have happened. Thoughts?

The other thing is kinda annoying me. I sold a car via CL, let’s just say it may or may not have been an Integra. LOL  So the buyer goes and flips it (I assume for profit). Cool, no biggie, except they NEVER registered, titled, paid taxes on the goddamn thing. Keep in mind they are supposed to have a lien as they took a loan to buy it from me. So they flip the car to this girl. She calls ME to say the bottom portion of title was filled out and it’s voided now and I need to go to DMV and get new title to sign over to her. YEAH RIGHT! :rx3:

I’m thinking I get proof my buyer has satisfied the loan/lien so there are no legal $ issues. Then I void my sale to them and techincally sell direct to the girl. Then I get half the profit that was made as well as any rush title fees to get my replacement title (since the original was foolishly voided), which I then sign over to the girl. Since my buyer never registered/titled, as long as the lien is cleared I believe the car sale can be voided. What do yall think? I mean I signed the title over 100% legit so I don’t owe anyone anything at this point. Splitting the flip profit is fair IMO since now I have a headache I have to deal with that was from no doing of my own. Thoughts?

Juat?? btw cole does not own cole anymore
its mavis tire

LOL. Which part needs simplification. You’re one that I was really hoping would chime in BTW.

Ahh that’s why they now offer tires. Mavis bought them late last year and this was recent so Mavis would be responsible then.

how can you prove they hand tightened the lugs?

edit* and why would they be touching/tightening the lugs for inspection?

The integra stuff is confusing me, but then my mind is a little fucked up these days
yoiu sold it to someone, signed title over etc… and they never reg/titled it., now she wants your help?
F her tell her to go after who you sold it to it was their responsibility to reg/title it not yours, i would not get involved
tell her to file a complaint aginst who she bought it from

He broke the law with the title jump, I’d go to the DMV and see what your options are.

your technically supposed to pull a wheel off to inspect brakes etc for legit inspection

Inspetcor can pull as many as he deams ne cessary to ensure safety- i own a shop i’m pulling all 4 to get a brake job, thats why you open/run a business($$$$). anyone who does inspections for the 21. is a fool

he broke the law being an unregistered motor vehicle dealer. He bought a vehicle and (assumedly) resold for a profit w/o registering it himself. I would not hesitate to prosicute it. IT would be a slam dunk. I’d get fines and possibly get his drivers license/registrations revoked. IT doesnt sound like you did anything wrong. However if you get involved and get a replac3ment title you are then offering a false instrument which could be criminal as you didnt sell the car to her

i’m not saying anything would for sure happen, but i’m a firm beliver in better safe than sorry

ok, makes sense.

In general, never ever ever get involved with a car you used to own once the title leaves your hand and the cash leaves the other party’s.

^agreed… but id probably feel bad for the girl if I was the ONLY person that could rectify the shitty situation.

She has options
willie
1 bond the title
2 file a complaint and if she can legit prove she bought it in good faith we can do a title hearing in front of a judge and award her title

I feel bad for people all the time when it comes to this kinda shit.

Word. Gotta use discretion. Maybe if she has at least C’s…

You guys wouldnt believe how shitty some people are in the car business. I daily see people that are poor(down on 6their luck) paying 2 $500 payments a month on a 2000 car at 28% interest

How long is “a while”? If they really were finger tight they would back off pretty fast.

As for the girl and your ex-car, just because the guy made a profit on the car doesn’t mean you’re entitled in any way to the profits. Stop being slimy and help the girl out without looking for the quick buck. I wouldn’t put a ton of my time into it since it really isn’t your problem anymore, but if she or the guy she bought it from want to bring some DMV paperwork to you to be signed to get a title re-issued to the person you sold it to just do it and wash your hands of the deal. Certainly don’t go signing the title over to her and pretending you sold her the car.

I would drop both issues. grab a lug from a junkyard and tigthen lugs.

Tell girl you didnt sell her the car and make the flipper figure this out.

it wouldnt be worth it to me

LMAO Fry. I haven’t seen her to comment on the breasts but I do feel bad for her being stuck. That said I told my buyer that I don’t care about any amount $ if it involves my neck on the line. If the law says title left my hands and he needs to be a titled buyer I’ll expect payment to go get a new title which I’ll then sign over to him and he can then proceed as the law states. By that time I bet his buyer will back out but at least he’ll have another shot at titling the car as he should have been done in the first place.

As for the inspection I have no issue with them taking the wheels off and I think it’s a MUST. But that was the only service performed between the time the car had all lug nuts and when it lost a lug nut. If they torqued them they wouldn’t be hand tight or falling off. It’s a matter of my word over theirs of course. I’m pretty persuasive and besides…they should be relieved I caught it before the fuckin wheels came off on the highway. It’s not like I’m saying pay me $thousands or else. I just want what’s fair, a set of lug nuts and I feel they should pay me for the inspection fee they botched and didn’t earn.

Thanks guys

this.

Clearly you don’t understand the legal implications. I was not the seller to her. I can’t go magically make the title in her name. It’s not that easy dude…or else I’d likely have done it. He has a lien on the cars vin too so there is monetary links that need to be paid off as well. On one hand you say just make it go away and on the other you say don’t pretend I sold her the car. Not fighting, just don’t think you get the gravity of the violation here.

Lug nuts…about 2 weeks though she don’t drive much. I do most the driving in my cars.
