so i got a ticket for 68 in a 45. is that guaranteed points? or whats the penalty for 20 over? anything guaranteed?
if you plea guilty it is guaranteed points (4 i believe plus fine). if you plea not guilty it is whatever deal they offer you, usually the deal of the day, 2-3 points.
i haven’t heard anyone get driving school as a penalty or plea in quite some time.
for a first offense i’d try to get parking tickets and driving school, hey why not try

but it wasn’t a speeding ticket so thats just what they were handing out before the d.a
depending on where you go to court, 21 over usually requires points in the deal with school. Under 15 is usually school and no points. But it all depends on which court.
guess it varies. i would have loved to get school.
i only took the deal of the day once… i got 2 points for failure to signal, but i was actually going 35 over and evading police.
i usually try to handle these things by writing a letter to the asst. DA. the best i got was 0 points and $115 fine for 30 over on the thruway plus evading police.
one time i called the asst. DA and got a plea from his secretary… 4 points and a $320 fine for 35 over on the thurway - yeah i took it after that i decided i wouldn’t let them catch me as easily… (see above 2)

Whats this whole write a letter deal? You actually wrote a letter to the da saying what exactly?
Ticket was in west seneca this morning.
Since it’s West Seneca more than likely you’ll be told to just show up. I’ve done the letter thing a couple times for tickets I got 4+ hours away from home.
Basically you call the court and get the DA or assistant DA’s name and address (who ever handles traffic court). You write him a very professional letter asking for a plea because you’re from out of town and (pick one of the following)
a student
a young parent
drive for your job
help the elderly
donate all your money to helping leppers in Mongolia.
What ever excuse you think will get you some simpathy. You send the letter and wait to hear back. If you’re lucky you get a letter back saying something like, "We’ll drop this to blah, fine of $XXX.XX (or if you’re real lucky $XX.XX) and you write the DA back accepting that. You never go to court, you just send a check.
well i took all the advice i got as well as hours of internet research and plead my case by mail.
one piece of advice is no matter how guilty you are, you must believe you are innocent. my draft letters went from “yeah i know i was speeding but he couldn’t have used radar successfully” to “i am positive i was not speeding and can justify the radar problems to the doppler effect and the cosine effect” or blah blah. i really go through about a dozen drafts per letter. each time you will make it more clear and more simple. keep it to one page.
if the court date i got in the mail did not have an asst. DA address i would call the court and ask for it. i would literally write them a letter with all of the vitals from the letter from the court (incident number, violation code, trooper name, blah blah) and would basically say yes i am innocent, yes i have a case, no i don’t want to waste my resources in court and i’m sure neither do you and i’m open to your suggestions on how we can mutually agree to a solution to this matter.
basically you make sure they know they are in charge no matter how much “proof” you have. that’s the difference between $100 fine and $300 fine.
the ADA doesn’t care about the story or how bad you feel, just that you believe you are innocent, you will make a case, you are willing to hear what he/she has to offer, you aren’t an ass, and most importantly, that regardless you will continue to pay close and careful attention to ensure safe operation of your vehicle among the others on the road.
that is how i got a 93 in a 65 while talking on my cell phone, while evading the trooper who had to go across the median and search me out at a rest area, on the thruway, in the part i knew speeding would get me a ticket… reduced to 0 points.
West Seneca will plea it down to a parking ticket, fine, and school - they do it all day long like it’s their job. Just show up and they will offer it to you.
