My bad then, city of Buffalo must be different! This was told to me by an Animal Control dude from Buffalo.
Yeah, town code says leash required only when “off premises of the owner” or some such shit.
^ If it went down as they say in the updated article, hang the little bastards.

So based on that, if unleashed and attempting to bite someone on the sidewalk, even in front of your house on your property, they’re violating the law.
Not that I don’t believe either of you, but I’m sure most owners of dogs that attack people say the same thing. My aunt and uncle’s dog was never on a leash. That golden would go do her business and then sit at the top of the driveway and watch people and cars go by.
Yep. Agreed.
The article said that the kids harassed the dog causing it to bark and then attacked it. Legally, a dog barking has no legal grounds saying that it is vicious so the owner did nothing wrong having the dog unleashed on their own property.
Barking dogs are not legally vicious:
The fact that a dog was chained and strained on its chain and barked when people approached was held insufficient to create an inference that the dog was vicious. Gill vs Welch, 136 AD2d 940 (Fourth Dept, 1988).
Also, if the dog never left the yard, then there is also no right for the kids to attack it. In New York, the section 120 of the agriculture and market laws that covers dangerous dogs:
Section 4: A dog shall not be declared dangerous if the court determines the conduct of the dog
(a) was justified because the threat, injury or damage was sustained by a person who at the time was committing a crime or offense upon the owner or custodian of the dog or upon the property of the owner or custodian of the dog;
Any way you look at it, these kids are the scum of the earth.
We have a place at Rushford Lake. Its in the trailer sections so they are close to eachother. The dog roams around free there as well. Never had one problem, people call him over and play with him (throw rocks in the water and watch him bring a bigger rock back) lol Also new people up there all the time so its not always the same face for the dog or smell.
lol… boxxa, stick to tech, which you’re good at, because your grasp of the law is horrible. You can’t quote precedent where a dog was chained and use it as supporting case law with an unleashed dog.
Rabbid rat dog? At most would have got a boot from me, no reason to hurt it, unless it was really persistent, then it gets picked up & put in the mail box…
- It’s disrespectful to people who are afraid of dogs. People out there do exist that are irrationally afraid.
- You’re dog is at risk to get hit by a car. Don’t take that chance, for the dog’s sake.
answers: 1. We will put him inside if we are told someone is afraid of the dog. People know that he is out and their are plenty of other dogs roaming around other than ours
2. He does not go in the street, never crosses it. I know you will say what if… but honest. he has never.
If he is just roaming around and up to a golf course near your house, how will you know that people are around that are afraid? You’re obviously not with him 100% of the time.
Yep, famous last words…Taking the chance is RETARDED. I can almost guarantee that if your dog takes off after a bunny or something, it’s not going to give a single fuck whether or not it’s in the street. This is how accidents happen, and it’s not fair to your dog. He doesn’t know what a car is capable of.
I seriously hope that you change your mind on whether or not you let your dog roam around a neighbourhood or w/e unattended if just for the reason that he is at risk of getting hit by a car.
I am just saying that the dog barking is not even legally valid to say “The dog was dangerous and off his leash so I was protecting myself.”
They physically went and attacked a dog they stirred up to cause to bark. I hate little ratty dogs with a passion and if they start barking or coming at my ankles biting, I will kick them to keep them at bay but never stomped on a dogs head or went to attack it.
The furthest he goes is to the first tee off. I can hear people talking from my house thats how close we are. As for going after an animal… He hasnt and its a risk we are taking. The dog has been much happier with freedom at our newer house than when he was in a fenced in yard. He looks healthier and does not remind me of a 10 year old dog but more like a 4 year old having fun. I know everyone talks about their dog highly, But we have never had an issue anywhere, and anywhere we have lived everyone asks about the dog when hes inside and why hes not out and/or if they can see him. lol
edit: I respect what you have to say and understand the situations you bring up. It’s my fathers dog, and our family knows its what the dog wants and we dont tell him no with that. We have the dog to make us happy but to also see him being happy and not with some family that cages him instead.
I actually lolled.
My golden. how could you be afraid of this dog. haha
haha
My neighbor has two old ass goldens that wander into my yard all the time (idgaf they leave my dog alone so we are cool)
They getting into petting range and bark at me. In my yard.
Guess I should stomp their heads…
Have you brought it up to your neighbors?
My dog is a lab mix. He is a purebred dick, 70lbs of mutt that doesn’t like strangers. The only times I let him off the leash is in the back yard or if I’m at area with no one is around. If someone came into my back yard they better be ready for some crazy shit unless of course they had a frisbee. The frisbee is my dog’s kryptonite.
