That statement right there is why the car shouldn’t of been on the road in the first place.

As much as some people do it, minor costs (towing) can avoid these kinds of problems.

Mark your forgetting the impound fees, the towing fees to the impound lot, representation fees THEN you can start to think about the final verdict, 2-10 000 and 6 point… it all snowballs

I am sorry guys, I didn’t make myself clear. No, I was NOT drifting or fishtailing between the van and the right curb with summer tires in cold weather. That would have been a stunt, a dangerous one :slight_smile:
I pressed the gas on 2nd at 40km… turbo was not even spooled. By the time I had almost passed the van I was hitting some prespool and the turbo makes some noise.
The cop is basically saying that I was drifting when in actual I made a quick lane change (after signaling), and then accelerated from 40-70km/h. I didn’t even go past 70 km/h, I let off immediately and was cruising around 65km/h.
The car is SAFE to drive, everything else was working other than not having wipers arms, washer nozzles, horn, and the reverse light. It was sure everything else was proper before I left the shop.
The ticket I should have gotten is “OPERATE UNSAFE VEHICLE” right? In legal terms it is “unsafe”.
There were no sounds of tire spin or anything of that sort… and my exhaust is quiet.
I hope this clarifies what I am trying to say.

I would take them to the parking lot and do some donuts/drifting and show them I CAN control the car. If you do your research and live in a perfect world, technically that charge would be thrown out since you can prove you can in fact control your car in a spin/slide.

If you were to get your car saftied, you wouldn’t pass. Either way, it’s the cops word against yours. Just get a good lawyer.

ya guys, sometimes I think when someone makes a mistake we can bash at them without giving them good advice.

He must be scared or freaking out, so any good advice would help, he already made the mistake now we can’t keep bashing him

not street ready meaning in legal terms (no horn and wiper arms). My car was safe to drive. And I chose that day to drive because it was around 5 degrees and won’t have ice on the road.

my car has legit plates, saftied, insured on the day.

Not having wipers is hardly “safe”.

HERE’S THE TWIST. I talked to the cop after getting pulled over, he looked under the hood and all that stuff and told me my car is not safe to drive because its got no horn and wiper arms. He said it would need to be towed, and HE AGREED TO HAVE IT TOWED TO MY HOUSE with their tow truck. I asked twice in order to verify. Then I was asked to sit in the car while he gets the tow truck. I was expecting “operate unsafe vehicle” charges.
Next thing, another cruiser shows up, the cop goes into the 1st cruiser and were chilling for like 20 minutes. He then goes back to his cruiser and takes off, pretty much flooring his car.
The tow truck comes, I help the tow truck driver load my car onto the tow truck. The cop returns, and gives me these pink papers. Tells me to sign to realize my car will be impounded and license suspended. Not to say I was shocked!!! After long argument he basically stuck to saying that I was fishtailing when passing the van. He told me to talk to the judge. He told me that it was the law, and that he saw me fish tail. What could I do? Grab his gun and shoot him??

Ur right. I should have towed it. But these charges are unjust. Like, RACING? What the hell?

He actually has to state (at time of being pulled over) that your car is being towed, and your license suspended.

Ok I was seriously giving you good advice… you NEED a lawyer, there is no two ways about it, most of the damage is done, they towed and impounded your car and you have no license for a week, this CANNOT be un done, regardless of what you get charged with in the end, this is the problem, you have already been told you were guilty when in fact according to the charter of rights and freedoms you are innocent until proven guilty by a judge. But this is money and time you will never get back, so put it in the past it’s done. Now what you need to do right away is make notes, the best notes you have ever made,recall everything that happend, EVERYTHING, how he talked to you, what he said, if he showed you what was wrong, if he showed you your speed, the reason he gave you for everything, make a file of this asap don’t waste time because you might forget things. Rember the cop made notes too, it is his job, his notes will be good, you need to be better.

Now because of the offence you will be requried to appear in court, if you hire a good lawyer then they will appear in court for you, all this first apperence is, is a meeting, your lawyer will talk to the justice of the peace and pretty much just say “look are you going to drop this or not?” and most likley they will not, then the next step will be to set a date to sate a date for the trial, once again your lawyer will have to appear in court to set a date for your trial, the way things are now this will take months, always plead not guilty.

During these months you need to prepare, take photos of the scene from every angle, YOU must take these photos no one else. Read any and everything you can, people have faught and won these cases, just be smart about it, talk to your lawyer about everything from the radar gun he used to the way he charged you, remeber in court you need solid evidence because it’s the cop’s word against yours, they will be trying to trip you up and expose holes in your defence, BUT the most important thing to remeber is to get a lawyer asap and move on with your life, it has happened and your not going to be able to un do what is done, so move on.
