Notice the muffler on this car…its also 2.25" catback n/a and automatic. When that thing starts i feel my insides shake. Been like that for 2.5 years and not once been ticketed for or pulled over…why?

Because my grandma drives it. no joke. To somewhat degree were getting discriminated because were young punks…but shes also got tinted windows a cop may not notice their pulling over a 60 year old woman…its how you drive. She doesnt budge over 2500.

“75. (1) Every motor vehicle or motor assisted bicycle shall be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise”

^^ this law… its totally in the officers discretion, so don’t even bother fighting it, however if he says your muffler is “improper” that is one you can fight, this has been discussed before, a search might help. (for the person about to fight)

Just take your car to one of those highway truck stops, apparently you can get them to search the entire vehicle, check it over, and then write a slip approving everything on the vehicle. When a cop pulls you over all you have to do is show him the paper work and your good to go.
One of the local shops said they had a customer do this so and it worked perfect
So basically get MTO to check over your vehicle and approve everything thats on it.

So to me this simply hear say, so i don’t know if it works but if one of you want to try or look into it further then please do.

Yeah it says ‘improper muffler’ on the ticket, the cop told me i can fight it in court if i show a receipt that i bought a regular exhaust from nissan. i’m not planning to do that though.

i read somewhere that one cop admitted that they don’t legally have the authority to determine whether an exhaust is too loud or not. i don’t think i can use that as a defense in court because it’s only hearsay, but i want to find more information on that subject.

also, i know that harley davidsons are legal to operate on the streets, and those things are 3-5 times louder than my own car, i literally have to cover my ears when they drive by because they break my eardrums. since their factory specs meet legal requirements, and a cop decides to pull ME over for a noisy exhaust, then something is clearly wrong in his perception of ‘loud’. i’ll only bring up loudness if i have to; because it’s subjective, it makes things pretty complicated when fighting off an improper muffler ticket.

anyway i think it’s a good idea to have my car checked by MTO at those truck stops etc. but for how long will that be valid? i mean, if a cop says ‘this was done two weeks ago, what if you changed something on your car in that amount of time? i don’t know if you did or not, so i’m issuing you this ticket anyway’. then you’re screwed again; and back to court you go.

i’m trying to form some points to make around these issues but it seems like the cop (if intelligent enough) could make a pretty strong rebuttal against each one…

srt4’s don’t have mufflers… just thought I would bring this up being as one of the laws that someone wrote here states motor vehicles need mufflers.

I’ve considered that defence;

a video + dB meter of;

  • SRT4 @ 5000rpm
  • SRT10 @ 4500rpm (?)
  • Harley (with factory mufflers-most people remove them shortly after they leave the dealer)
  • Your car @ 5000rpm

IF you can show yours isn’t the loudest… bam case dismissed

Heh … nope. They pay the dealer $500 for a “drag exhaust” option. Which is a mechanic, a railway spike and a sledge hammer. Couple whacks to break the welds in the baffling, back the bike up to a wall and rev it till its done spitting bits out.

But again, motorcycles have gotten clemency because enough people, many of them lawyers themselves, fought hard for it. They were able to prove that a loud exhaust saves lives. Too bad you won’t get the same treatment in a car.

A bunch of kids complaining that their unnecessarily loud cars are being picked on isn’t quite as graphic as “you’re killing motorcyclists with your law”.

Realistically, 90% of the exhausts you hear out there are on cars that are not in any way benefiting from a 3" straight exhaust.

How you drive your car is a huge factor. If you feel the need to wind the motor up to redline in every gear, shift badly, pretend you understand why people double clutch, you’re gonna get pulled over.

Is it really that hard to grow up a bit and run a quiet exhaust?

Thats why i believe u get a list of parts that the MTO agrees or signs on so when the cop pulls you over on the list it says Apexi exhaust etc etc and at the bottom of paper mto signature/stamp of approval. The cop can argue all he wants and give u a ticket but u can win that one a lot easier in court i would assume.

I’ve got a 90 mx6 gt with a 3" exhaust, no cat, no muffler just an 18" magnaflow resonator and the ONLY time i’ve ever gotten a ticket was reving the piss out of it downtown london on a saturday night, and even that was a noise violation not an improper muffler ticket.

When i got pulled over for my exhaust, tint, ect the cop told me hes giving ticket for this and that and I just talked to him in a very polite manner and didnt really tell him but said stuff like “isnt the muffler supposed to be under 90db?” random stuff like that talking out of my ass. Had no idea what i was talking about but i would just kinda question everything he would say and he gave the usual answers that he has to be able to read my license through the tint blah blah blah and that the mufflers don’t meet Canadian specs and i just said yeah its a magnaflow muffler which is made in Canada for this market ect ect (again bullshitting i think i might have even called it a master craft muffler) He ended up giving me all the tickets and when he did i even said thank you and went on my way. over 8 months later and no letter telling me when my court date is so i assume he didn’t file it. Im assuming if you act very nice and pretty much kiss the officers ass n shit then you increase your chance of the officer not filing it unless you are revving for no reason at 6k. I have gotten out of the three tickets that time and another one a couple of months later. Always helps to act semi retarded and say you know nothing about your car and that you just bought it this way and assumed it was legal and say you will replace it immediately and ask them where you could get it done ect (makes them feel more knowledgeable i guess). I know this doesn’t help you situation as it stands now but maybe in the future it will as it has for me. Good luck

Harley Davidsons that are too loud also have aftermarket exhausts on them, their stock exhausts are not as loud as the ones you hear ripping your eardrums. bike gangs always get pulled over and they hate these tickets just as much as you do. we hate biasing towards street racing yet we bias bikers without knowing anything about motorcycles? why?

believe it or not, althuogh its not improper, it is still louder than a normal vehicle under some conditions, and it is not a stock exhaust system, so it meets the ‘unusual’ criteria, anything not stock falls into that trap

also I dont think getting your car inspected with your new SR20 is a good idea

you are lucky the cop didnt proceed to check everything, and you shouldnt wish for a cop that would, because you could potentially get screwed, although sr20’s are not illigal on paper, in the end it comes to the judges decision depending on the case’s path

and no matter how much we hate exhaust tickets, they often get us off other charges such as reckless/dangerous driving or illigal engines. when a cop pulls you over, he often knows you did something wrong, but knows your just screwing around and that they used to do that as well so they let you ‘off’ by writing you an exhaust ticket. a cop can write anything from improper turning, reckless driving, hey even hopping a curb in a parking lot with your suv is a careless driving ticket.

so its up to you to fight it or not, your muffler might not be improper, but your not in the best situation to fight it, i got off 2 noisy exhaust tickets and paid 3 of the 5 that were written to me last year

i always thought the receiver of the ticket must do 1 of 3 options within the speculated time (15days or 30days local).

if you don’t file any of the options, you default your right to explain your situation therefore having to pay the set fine.
