Here is a write-up i did on how I will do my own ticket fighting. please dont post everywhere. its just good information to be educated and i wanted the MEMBERS to read haha… My friend has done these steps every time and has gotten away with it every time so far.
Be educated in battling your minor court tickets…use as reference only. I am not liable to any of your results, just helping people to remember to check if officer is there. Most people don’t and end up getting suckered into paying a lower fine and still have a small build up of tickets on record which is bad for insurance. if they dont show up your ticket is dropped no matter what wrong you have done.
-Do “Trial Option”
-Get a “Trial Date” in the mail
-Go to court room, go to court date on time(early).
-Talk to Crown Attorney during “Attendance”
-Ask if your officer is in the court today. (Only the crown attorney will know if your officer is here or not and will tell you.)
If he is there…
-You are allowed to speak with him before the proceedings
-Ask him to drop the ticket because:
• You’re a student
• You’re a young male driver (insurance will go very high)
• Don’t want to tell parents…etc
-And not just source it.
-Tell him you are willing to justify the situation by doing a good for the bad. Ask him for a DIVERSION, tell him your willing to donate money $$$ (charitable donation) to a foundation of their choice i.e. (sick kids). Also if he is hesitant, tell him you make very little at your job and your worried you wont be able to pay the ticket, as well as your future increased insurance premium.
-Once he has agreed to a “diversion”, he will discuss what you will say in court and he will probably give you a piece of paper to take with you back to court.
-Agree to pay the “diversion”, and the ticket (fine, demerit points) will be DISMISSED all together.
-The End
If he is not there…
-Go into court
-Do not agree to pay a reduced fine.
-Stick to your verdict of NOT GUILTY. (Very important)
-Wait for different cases to take place and wait for your name to be called
-When you’re called they will go over your case and ask you how u pleads.
-Once again, last time you say, “Not guilty”.
-They will tell you your officer isn’t present. Since your officer isn’t there, your case is dismissed.
-The End
Or
RARE…risk…If he is there LAST minute rarely… (crown attorney told u he wasn’t here and they give him a call to come)
And you went through the above of “not guilty plead” … and then they state the officer is there… you can have the balls and in front of the whole court audience and ask for a diversion and convince the court with your speech.
That is the only ways I know of to stay a clean record and this works for many tickets that costs even $340 i.e. speeding tickets. Paying a donation is better then paying your high insurance premiums later on…
