well my last call went a little something like this…
Hi this is Josh calling again and I was wondering if I could speak to gary… no sorry he’s gone home for the day… ic well can you tell him that i have been trying to reach him several times today leaving several messages to call me back and still nothing… also my insurance company says that if i dont get his insurance information by tonight the BBB shall be getting it tomorrow… and she replied with ok i’ll tell him…
about 15 mins later i get a call from him saying o hey josh ya i just got back to the office and i got your messages… why do you need our insurance information… i then tell him my insurance company needs it… he then tells me that if they need it they can call him… wasnt to happy that he STILL refuses to give me ANY information… i then say ok have a good night bye…
This is the way it should be handled. I would question why your insurance company wants you to do their legwork.
The fact is, your claim is against your own insurance. They’re the only people you should be directly dealing with. The accident was not your fault, you filed a police report, and the insurance company needs to fix your car. Period. If they want to recover their money, they need to get it from the towing company themselves. But that’s not your problem. Your claim is against your insurance, not the towing company.
If it becomes more complicated than that, the next time your renewals come due I’d remember that there are other companies out there who’d be happy to take your money.
TELL HIM you need this iformation to submit a “claim” gainst his company for damaging your property.UNLESS he is willing to settle this damage personally and accept liability for their actions. Tell him you don’t care whos fault it is and let his insurance companie settle it if he thinks it somehow ur fault. And i would call BBB no matter what and complain, so they get a mark for what they did andd how they handled it.

no i only have plpd otherwise known as one way lol… and my insurance company said that i have to handle this threw the towing company’s commercial insurance… my insurance company is morgex, and the car has been sitting in the towing yard since the damage…

indeed lol… i knew about this… i probably wouldnt of made this thread if i had full… but now that im on my own im needing some guidance in the right direction!
ok so yah call BBB 1st. They will get on his ass. So far kingsway has 0 complaints on BBB database.
Than call Kingsway and tell them:
" My vehicle was in your custody and you are fully liable for my repairs and expensses."
" My insurance company told me to get name and policy # of your commercial garage policy so i can submit my claim if you don’t want to settle the repairs yourself."
“My insurance company requested me to get this info from you and by law you have to provided it, they will not contact you becouse they do not have anything to do with this claim”
If no go there you have to go policE station and file a report against them for damaging your property, just like someone ramming ur house with a car.
thats all that comes to mind. you can try and ask morgex agent of yours for a favor, have him hassle buddy for info.(he doesn’t have too, but may help you out)
If still no go you will need to get legal consil , pay up impound fee’s and submit a lawsuite against them for damages + expensses and legal costs.
