Transfering case to a more Local court?

Say if I were to get a court date for a place that’s 3 hours away. A friend recently told me that I could have the case transferred to somewhere more local. Meaning I’d have better chance of winning as well as making it more convenient for me and my lawyer. Can anyone shed more light on this?

If that was true… I missed out a big opportunity big time and could still be driving right now :frowning:

Yes it is possible.
You can file a motion to have the case moved. I don’t think it is likely to be granted with Traffic Court though. Who knows

Yes, you can file a motion. However it’s up to the original court to decide whether to move it or not.

I don’t think the “busy” cop would be willing to travel three hours your way for one court case.

In this case it seems a little more difficult. The motion would have to be in front of the judge, so you’d still have spend three hours to go there to get it moved to your court.
Make sure you have all documentation showing why you would like to case moved to your jurisdiction. The Judge WILL ask why you would like it there and ask the Prosecutor why you shouldn’t be granted this motion.
He will probably say that the cop is fully aware of the location and also has evidence and can give a full and proper description to what happened on the location. The judge in the next jurisdiction may not be able to interperet his evidence because there may be first hand experience for him to better visualize it. This is an extremely strong statement and it can be difficult to be granted the motion over. Make sure you and your lawyer come up with something extremely solid.

yeah i agree, if u dont have a valid reason besides “because its far” ull be shit out of luck , a friend of mind did that because he had to take care of his sick aunt and got the change.

That’s why I got 30 days suspension. But if I knew this sooner, I would have still went and done something to move it as it increases my chance of winning. Better than 30 days of suspension, $850 fines, and friggin 6 demerit points.

just be thankful that its just 30 days. try to be careful next time. from what i hear if you just store a 350z for 30 days the engine starts to lose compresion so its a good idea to let someone drive it for you in the mean time.:wink: i kinda know how you feel. its been more than a month since ive driven the GTR.

I drove it two days ago, so no need to worry about that. Just around the neighborhood at certain times hahaha

I don’t think the odds would have been good for you getting the motion granted anyhow. Your only option right now is an appeal.

but it says on the 350z manual that you need to drive it at least 50km away from your house to let it warm up properly. :smiley:

s14_2nv is right. You can only file an appeal right now but I think it would be harder to get win an appeal than it would to be granted the motion. Not that those two things are directly related anyway.
Second an appeal is most powerful when you file it immediately after the judgment. If you file it right now (a few days to weeks after the judgement), you’ve made it even harder for yourself.
You would be re-opening the case which would mean more time spent with this matter.
But you could file an Appeal to get the case re-opened and then file a Motion to get the trial moved. Everything is a huge up-hill battle. Good luck

btw … where’s your lawyer in all of this? i would think that he would know a lot more about the policy, procedure, and steps required for an appeal or motion to move the court location.

hahahaha they’re never around unless you’re paying them. If you’re not paying them enough they don’t know anything about these processes.
Some Lawyers are good and they only try to help their clients, but I’ve experienced way too many “bad” Lawyers that only flaunt the fact that they are classified as Notary Public.

Apparently, he went to Hong Kong for family matters and left his firms to the hands of n00bs. ****! I wouldn’t be surprised if the n00bs went to fight my ticket in court.

Initial Fee of $300 to right the ticket. But it was in Napanee, so he charged an extra $200 for gas and his inconvenience :rolleyes:
