And these fuck bags made it all the way to the supreme court. They protested at another Marine’s funeral. Father of Marine sued and was awarded $5 million in damages, higher court overturned, now it’s in front of the supreme court.

If I had to judge an outcome from just today, I’d say the church’s case is in bad shape. But we’ll see. Even Kagan was on to them;

Kagan quickly pressed her. Would it be permissible, she asked, for the protesters to pick out “a wounded soldier and follow him around,” holding “offensive and outrageous signs” near his home and calling him a “war criminal?” In such a case, “does he have a claim for intentional infliction of emotional distress?” Kagan said.

Phelps hesitated, but then said no. “My answer, Justice Kagan, is: No, I don’t believe that person should have a cause of action.”

That answer appeared to turn the argument against Phelps and the funeral protesters.

From everything I had previously read and listened to, this was going to be an open and shut win for free speech. Guess that Westboro should have gotten a better lawyer rather than keeping it in the family lol.

They would have been fine if they just focused on making a statment, but they went after the dad personally;

How could the family not win a civil case against the church for emotional distress? Also confused if cemeteries are private property if they’re military cemeteries.

You can use it as is convenient for oneself and because there is no god one only need answer to oneself.

with westboro though, i find it hilarious because it’s not me they’re targeting… but i definitely sympathize with the soldier’s family. How you put a dollar figure on it though is beyond me… certainly not $5M… unless the guy is hecka rich to begin with and can put a factor to his health that equals $5M or more… but i doubt that was the case because rich men don’t send their sons to die in silly wars.

The make a living purely off of lawsuits from angered people. As much as i would love to put a bullet in them, it’s what they want.

I feel that some day they will cross someone that doesn’t want to deal with pepper spray or words, and will give them what many think the deserve. They will be right, but they will be hurt or dead. Life is a mother fucker like that.

They can do this because they coordinate everything with local police/government before their protests. They always follow the rules that are given to them by the local police/government. It is the same process that “activists” have to go through in order to legally protest a gathering.

As for the case it’s going to come down to linking the protest directly to the family, not the war. If it was targeted at the family it’s harassment and that’s not protected speech. Definitely in for reading the full opinion when this one comes down.

i have no doubt in my mind that if i was burying my son/brother/sister/mother/father and they showed up, that i would be in jail for awhile. with zero regret.

But as far as free speech, Aaron Sorkin said it best:

America isn’t easy. America is advanced citizenship. You gotta want it bad, 'cause it’s gonna put up a fight. It’s gonna say "You want free speech? Let’s see you acknowledge a man whose words make your blood boil, who’s standing center stage and advocating at the top of his lungs that which you would spend a lifetime opposing at the top of yours. You want to claim this land as the land of the free? Then the symbol of your country can’t just be a flag; the symbol also has to be one of its citizens exercising his right to burn that flag in protest. Show me that, defend that, celebrate that in your classrooms. Then, you can stand up and sing about the “land of the free”.

Aren’t they imposing their beliefs on these soliders? Sinning is a belief of their religion not nessecarily the soliders or their families.
