Damaged car due to Road.

Well I was driving home from my girlfriends house traveling down French road towards Union road at 9:21 p.m. and at the residental home of 554 French road I had hit a hole in the road in the out most lane. This hole had made a loud bang almost like the sound of a rifle shot. Arriving home at the time of 9:26 p.m. I had inspected the visual damage and it flattened one tire, as for further inspection inside of the vehicle, I had discovered the back rubber boot on top of the rear strut tower was missing. I had pushed on the car to make it bounce and i had noticed that upon hitting the hole on French road, it pushed the strut up into the hatch area. The top of the strut tower had broken and now is free to roam. Not knowing if there is a body plate there along with the top strut plate, if so that was broken also. I had called the Cheektowaga Police to file a complaint at 9:31 p.m. The lady said she would also send a police officer to the site. I was on the phone with the Cheektowaga Police for Six(6) minutes and Nineteen(19) seconds. I then took pictures of this damage. Next I had gone out to the site at 9:43 p.m. and there was an officer waiting for my mother and I. We had searched for the hole and it was thought it was to be infront of the Wilson Farms on French road. the officer then found the hole further down French road towards Transit road. The officer had then blocked off the road so I could take pictures of the hole. A neighbor claimed that the hole has been present for a two(2) week period. The officer had filled out a card with the complaint number(#) his badge number, site of the incedent, and his last name. The hole was the entire width of the lane with a deeper hole, approx. 11" wide on the farthest left side of the lane. The length of the hole is two and a half feet(2 1/2 ft). The officer said to call the Highway Department in the morning to complain about this occurance. I am also going to have this inspected for further damage by my mechanic. An estimate will be made and presented to the Highway Department also.

Is there anything else I should do. Pictures are already taken of the visible damage. More pictures will be taken by the mechanic.

you can present it to the highway department all you want, you wont be getting anything.

Its a road hazard, you should have avoided it. If you have collision, pay the deductable and get it fixed, if not chalk this up as a learning experience.

I went through this once, they put it on my insurance as an accident and raised my rates for 5yrs and made it so places like Geico wouldnt even offer me insurance

in the long run I think it cost me even more $$$$ than if I had just paid out of my pocket

The hole is not noticable if i saw it i would of avoided it.

If they want to let insurance handle it i will end up paying out of pocket.

Those plows really tear up the roads in the winter.

BTW on a 2g dsm i know theres a top plate on the rear strut, but is there another plate on the body? If not then the top mounting plate just broke and pushed the strut up into the hatch area.

i drove this way home today from work… i didnt see any hole at all so it must be new, i got home from work around 5:30pm

I had this happen about 4 years ago on Center Rd near Holland. I called 1-800-POT-HOLE (Not Lying) and reported the Location of the hole. I got my tire and rim fixed. Took the bill to my insurance company along with info I got from the call I made (I had a comfirmation number or something like that) and got reimbursed for it from NYS. Took 6 months but I did get a check. Apparently, it is covered depending on the case. Location of hole, how long it was there, was it reported before, who else hit it, etc… If the Police were involved you may be able to take it to small claims. If it is worth it. I was out $600 on a rim and tire but all I did was hand the info over to my insurance agent.

I am pretty sure they have something ridiculous like 6 months to fix it or they aren’t liable…

it sucks but you will probably end up having to take care of this yourself.

your screwed man…i went over a man hole cover over the summer and it was on properly and it pulled off and caught into the ground and then caught my rear end and tore out my diff and on axle welll practically flipping the car and they told me it was my fault?

If you report it to your insurance it will count as an at fault accident, and will remove any careful driver discount that you have.

I hate this city, im moving to florida. Roads are maintained much better. Fuck, even Ohio had nice smooth roads.

florida doesn’t have to do anything to make their roads nice. NYS is constantly fixing them cause of the shitty weather

The city/state is not going to end up paying anything. If you have a legitimate case, your claim on your collision will not be an at fault accident, however, it probably will end up being one as its rather difficult to prove it was unavoidable. I did so with pictures etc and insurance covered the several thousand dollars of repairs and rentals when I hit a dislodged manhole cover in my Audi at night in the pouring rain.

fuck that i hit went over one two hours after it rained and it was unnoticably unlodged when i was driving so i didnt even think to swerve and it wrecked my car…and the town told me to go shove it
