someone explain to me why they are doing this…
Seems pretty simple to me, you can’t install a basketball net on the property between the sidewalk and the street. Pretty much anywhere in the US that is a city/town owned right of way and you need permission to do anything beyond planting small flowers there. Pretty sure this applies in Canada as well. There would be major legal ramifications for the town if they were to leave a basketball net like that. It implies the town is saying it’s ok to play basketball in the street and when the first kid gets run over the town will be the one facing the lawsuit.
EDIT: And those parents are huge douchebags. I’d put money on that guy’s cane being part of a personal injury lawsuit against someone. Just a hunch.
^ at first i was like… what is this blasphemy??? and then i saw JayS comment and it was alllll good
you’re probably right, but some of those hoops look like they could have been moved into their driveways. They should have been given a chance to move it before they removed them.
^they were given 60 years -.-
^there should have been a written notice with a given deadline
Sounds like it has been an ongoing issue with complaints listening to the guy in the video. He says something about, “the guy who made the complaint that started this all back in September”. I don’t know the date they got ripped out, but when you hear “back in September” you can assume it’s been more than a month.
So again, fuck this guy and his basketball pole. Or better yet, fuck this guy with his basketball pole and send a real message.
^nahhh
Several residents were sent letters last year warning them that the state’s “Clear Zone” law prohibits trees and other objects from being within seven feet of the pavement’s edge in a residential subdivision.
John and Melissa McCafferty said they’d gotten more than one warning letter, but that police cars and heavy machinery showed up without warning Friday morning to remove the hoops.
Game, set match. Jays, flawless victory.
ok so they were sent letters. then this guy is a retard.
I hope that they were billed for all of the workers it took to clear the violation.
“DelDOT is sympathetic to parents wishing to provide young people with recreational opportunities; however, public streets are not a safe location for those activities. The Delaware General Assembly passed a law in 2005 stating “sporting and recreation activity taking place in and adjacent to the State’s public rights-of-way . threatens the safety of the recreants as well as members of the motoring public,” and that law stated that “the Department shall make every effort to remove from public rights-of-way devices such as basketball hoops.”. 17 Del. C. § 149(c).
DelDOT crews acted on Friday March 25, to remove seven basketball goals within public right-of-way in the Ashbourne Hills and Radnor Green subdivisions in New Castle County. DelDOT did so only after receiving a complaint from a resident of the area in which the basketball hoops were located.
Since that time, the eight homeowners with basketball hoops in violation of state law were contacted multiple times via certified mail about the need to remove the obstacles from the public right-of-way zone. One resident voluntarily did so. The remainder did not. Because the basketball hoops were not removed, state law requires that DelDOT remove the goals to protect the public. The final goal was successfully removed by the state at approximately noon on March 25.”

Also a good read, The spin this has on a Pro-Ron Paul blog
http://www.dailypaul.com/160575/deldot-steals-families-basketball-hoops
Delaware Department of Transportation removes all basketball hoops close to streets where children play because they have “the right of way.” When family protests, DelDOT calls in the State Police who show up and feed the family lies to get them to move their vehicle blocking the street. When the family realizes they’ve been lied to, they start to protest and the officers threaten to arrest them for disorderly conduct. Luckily, the couple is aware of their first amendment rights and it was all caught on video.
Isn’t there a childhood obesity problem in this country? Why would they be taking down things that encourage outdoor physical activity for children?
I’m tempted to sign up just to post on that Ron Paul blog something like:
"What is wrong with America today. Fat little kids playing b-ball in the streets can solve so many problems.
- They’ll be active, and get less fat. Then they’ll use less healthcare and be less of a drain on society.
- When they get hit by cars those cars will be repaired by hard working Americans in American owned collision shops.
IT’S A WIN WIN. AMERICA, FUCK YEA!"
don’t forget the doctors and nurses that will get paid to fix the fat kid
Isn’t there a childhood obesity problem in this country? Why would they be taking down things that encourage outdoor physical activity for children?
Thats what I was thinking? Why did these basketball hoops start to bother to government now. As they said in the video they have been there 60 years, if it was a major problem they would have taken it down ages ago

I dont see how they would get hit by cars. The streets the basketball nets are on, are very small, usually circles.
When I lived in Craneridge (across from Kissing Bridge) it was very nice with just wood street signs. Then one day they came in and started to put up at least 100 metal signs and used, rusty gaurdrails all over the place. It absolutely ruined the whole natural look up in there. They had to for legal/liability reasons. It just sucks all the way around.
When are you NOT on the side of some stupid argument? It doesn’t matter what it is you are ALWAYS negative about anything that is contested.
So what if they got warning letters… If you actually listen to the video it sounds like they started a dialog with the state and the communication between the two never finished before the state employees came to remove the basketball hoops.
Furthermore if the thing has really been there for 60 years it should probably have grandfathered immunity against any legislation that was enacted after it was put up. What rubs me the wrong way is that it sounds like these people didn’t even get a real chance to contest that before they came and ripped it down. The dishonesty on the part of the police officers in the video was rather disgusting as well.
Karma’s a bitch though.
I know a church that does that
