You hit the ball on the head… they dont like doing the paper work, and most likely wont do it. Therefore the end result is a dropped ticket, you ask for evidence to be submitted into your trial, it doesn’t come, dismissed. This is the main reason NYS troopers now AUTOMATICLY print out the supporting dep with the ticket, and hand you both. 2 birds with one stone, loop-hold is gone for the defendant and the officer doesn’t have to do more work or forget/disregard doing so.
Not to mention, out of ALL the tickets I have appeared for, I have yet to speak to the officer for any sort of a plea. When the judge ask you how do you plea you say not guilty and request a trial by jury when the da is available. The officer doesnt need to show up, unless called upon to appear on the date of the trial… as in you, the da, or the court asks the officer to show up.
I am not proud to say it, but i have been to asked to appear at every court house in a 60 mile radius of my home. I also am very close friends with 2 lawyers, the Amsterdam city district attorney, 2 judges and many officers in my home town.
