Need Advice (Bought a car with a lien)

I Just bought this car on wednesday this week

And on thursday i called fulblown motorsports to get a price on a new front bumber cover. It talked to Josh at fulblown and he told me that the person i bought my car off of has a $3000 parts bill that is unpaid. So the the car was used as collateral for the unpaid parts bill. So i went to the registries friday morning and sure enought there is a lien on the cars title under fulblown motorsports.

When i purchased the car i asked the seller if there was any money oweing on the car as well as if there was any liens or encumberances. He told me there was not. When the bill of sale was filled out it was stated there was no liens on the car with the sellers signiture. To my knowledge this is a legal document that he had lied on which is fraud.

So i am looking for advise on what to do, i have never been in a situation like this before. I geuss this it was happens when you trust somebody…

Its not looking like he is willing to pay off the lien on the car so i am thibking of taking legal action. i am thinking of taking this to small claims court.

I believe that i should not be responsible to pay off his lien and that i am a victim of fraud.

Any Advise on what to do??

ive always been told to check for leins but i never really worried about it. id would have to agree with you on the fact that he said there was no leins and signed for it. i would call a lawyer that give free advice and ask them. if not a lawyer then maby the registry office would be able to tell you.

HA! Derek had no idea that Josh did that to his car. Please don’t believe his bullshit. Can’t wait to find out what kind of lien the bastard put on my car. Funny if he thinks he deserves any of what he thinks he does.

Please, if you take legal action, sue Fulblown Motorsports. He is running an illegal and shady mother fucking business.

He put the lien on your car without Derek even knowing. I heard he’s getting sued by a couple people already. I may add myself to the list if he put a lien on my car.

Don’t take action about Derek, he didnt’ know, and wouldnt intentionally do this to you. Don’t believe Josh’s lies. You should know better Austin.

This has nothing to do with NECC, everyone does a lien check before pucchasing a vehicle for this exact reason.

Go to the police station with a copy of the bill of sale and file a report.

Cover your ass.

In canada the chain of suing goes

you–>Previous owner–>person who has lien.

So you sue derek, derek alone sues fulbown

Thats pretty much for if you bought something through the marketplace that turned out to be a scam. Then they will help you to the best of there abilities. I had a problem involving this (thats why they say that now) and the NECC guys did their best to help me.

dont want to get off topic, but yah im sure they did, i wasnt saying necc useless in anyway. just simply passing the word to someone else. doesnt matter anymore hes prob going to go to the police and get it fixed.

We are more than willing to lend a hand in bringing a possible conflict to an end; be it via the police, or just a mediator between the parties. If there continues to be a descrepancy, then since the goods have been sold through the NECC site, we will decide (with time) where the burden should be placed.

Since the goods were not sold through NECC, then we have no responsibility anyways.

If you bought a car through a posting on here and the engine blew up a week later…what would the NECC be able to do about it?? Nothing. Doing your research before a sale is usually a good idea.

I believe the Police would be the apropriate authory to handle a situation like this.

But for not i believe the guy who sold me the car is trying to work things out with Josh to get the lien removed. I am thinking of giving him a few days before i have to take legal action.

Sue fullblown if they are in the wrong. Why sue some guy who didnt know? just because “thats how it works” Fuck that, getting sued is probably a HUGE stress that nobody needs unless they deserve it. If you sue him, your just hurting the community that you live in, but if you sue fullblown instead, you are only helping EVERYONE who got screwed by them(use there cases against fullblown) and EVERYONE who may have thought about future business with them.

no no, call amvic on monday asap, as soon as you take action, things are going to move faster and ppl will see you are serious. amvic will help you out, but they’ll need time, so dont wait each day counts.

He has no legal right to sue fulbown. the lien was not placed on the vehicle when it was registered under his name.

His only path to getting his money back is to sue the previous owner if everthing takes a turn for the worse.
