Based solely on what you printed, the car driver is at fault.
A vehicle turning left must YIELD the Right of Way to any oncoming
vehicle, period. This includes yielding to a motorcyclist traveling at an (allegedly) high rate of speed. This is NYS Vehicle and Traffic Law. Don’t agree? Too bad.
The speed of the motorcycle may be a causal or contributing factor, but based on your eyewitness statement, the car driver turned without yielding. Everyone is always in a rush to blame the squid (squirrely kid) on the crotch rocket, but it’s usually the inattentive middle-aged clueless soccer mom or dad that takes out these bikers.
whoever the two asshats were that were tooling around on the 33 in the middle of rush hour traffic 30 mins ago are sure to be # 4 & 5… One of them was wearing sweat pants, i shit you not.

Then on Saturday, Amherst Police say, a man driving a dirtbike the wrong way down Dodge Road at about 6:30 p.m. hit a car head on, after another car had to swerve to avoid hitting him.
Philip Gaulin, 46, of Amherst was taken by ambulance to ECMC with a serious head injury, compounded by the fact that he wasn’t wearing a helmet.
He does not have a license and his motorcycle was not registered or insured.
I know who owns the car. Its a Blue Subaru BRZ. Got some of the story the other day about this due to it being a friends cousin. Car got bashed up really good in the front. Stupid for driving the dirt bike where he did.
Take another look. I know exactly who the owner of the car is, and exactly the claim he did with his cousin about fogs and how the BRZ has fogs. lol Only reason I know its a BRZ.
Edit: probably should look at the video again, shows Subaru for sure. Also one car I’ve been looking into a lot and really like, so I know the difference in look.
A motorcyclist is accused of driving drunk, after his motorcycle started on fire Saturday in Monroe County. State Police say a concerned citizen notified them about the motorcyclist on the westbound side of 104 trying to put the fire out.
Police responded to the scene where they say 58-year-old Richard D. Schuldes, of Rochester, was trying to start the motorcycle while smoke was coming from it. Police say he smelled like alcohol and refused to perform sobriety tests. He was charged with DWI and other tickets.
Alcohol and bikes do not mix. Its one things having the balance of all 4 wheels (still never a good idea) But 2 wheels and alcohol… really? Lets go back to the bike path incident if we need to.
