Stunt Driving Law Deemed Unconstitutional.

So, if we bust open everyone’s door to find drugs and guns and start confiscating them with no real reason to go in, and that helped out the community and we should still continue to do it?

Pretty stupid argument.

Even if it did bring down accidents and speeding, they are doing it in a wrong approach and “Unconstitutional”.

Funny how all this comes about after this Michael Bryant bs. I bet law gets dropped until he is cleared, then, gets reinstated under a new name.

"So apprently Toronto police and other forces are ignoring the fact that an Appeal Court Judge has ruled this unconstitutional and have been issuing stunt driving charges for speeding offences over the weekend and they say they will continue. This is a total disregard for the Justice system.

Many of the Officers that have issued these over the weekend also charged the person with Speeding 50/over under sec 128. So they have 2 charges. One for Stunt driving(sec 172-50/over) and one for speeding 50/over (sec 128). This way if the stunt charge gets dropped they still have the speeding charge to rely on. Yet the are towing the vehicles and suspending the licences.

Someone needs to file a civil suit against the Province asap."

A newly enacted provincial law that targets dangerous drivers has been ruled unconstitutional by a judge in Napanee, ON. The judge found that Ontario’s street racing and stunt driving legislation carries a hefty possible prison sentence, but gives the accused limited grounds for defence.

Ontario Court of Justice Judge G J Griffin made the decision Friday. However, that doesn’t mean cops will stop handing out tickets.

OPP Sgt. Dave Woodford explained on Breakfast Television, “We’re still enforcing it.”

Furthermore, in a weekend safety blitz, the Ontario Provincial Police laid over 7000 fines on our highways. That included 133 impaired driving charges, 7193 speeding charges and 10 of the controversial stunt driving charges.

“Under the stunt driving and street racing legislation there are a lot of different definitions and one of them is going more than 50 km/h over the posted speed limit.

“That’s the portion of it that we mainly deal with on the highways, but there are others, like going through intersections,” Woodford added.

so does that mean if someone does a stopping role on a 4 way intersection they could be charged with stunt/street racing?? :S

Just heard that 2 more judges have tossed the street racing. Just an update/bump as it violates the right for defense due to lack of time.

Ontario sucks for insurance anything car related.

Still in affect but a few cases have now been thrown out due to the charge being unconstitutional.

lol, i don’t have a problem with someone speeding 50+ getting raped in court, i just don’t want cops to have power of this kind, i don’t’ want you to get fucked on the road side.

But yeah, your probably right, but at least the new law won’t fringe our constitutional rights, and take some power away from the corrupt cops.

Eh my 240 felt safe at 190km/hr with KYB agx lol… meh… i just dont feel safe from garbage roads more so. Finally some asphalt layed on 427… and despite being ‘new’ its not straight/well made… pathetic.

Honestly I think we should be allowed to cruise 140-160 on the highway in the left lane… but what can I do… the law, the media, people their cars and driving… its just never gona materialize.

They got this show on discovery called “Canada’s worst drivers”.

They showed this guy sweating scared going 120km/hr. He was like OMG I just did 120km/hr face palm

I bet he would get cardiac arrest if i told him I went 260km/hr in europe…

The only roads we have here in ontario that feel close to europe are 407 and the 400. 400 is an easy 200+ road at least certain parts i drove on… i love it. But meh… what can you do gotta obey the law.

there should be classes of licensing other than G.

after G you should be able to get technical driving certifications and car-specific certifications that support your ability to travel at faster speeds.

the same way a nexus card deems you low-risk for crossing the border these certifications could give you another 20kph priviledge on 400 series highways.

The laws have to reflect the general ability. For everyone of us that is a pretty talented driver there are a dozen or so people like one of my brothers and my sister who can’t drive for shit in an automatic car… i wont even drive with them they are so inexperienced behind the wheel… the law is for their benefit.

this shit would also mean that more people get more training to drive and in general it would increase road safety… these certifications would lower insurance too so you wouldnt just get htem to drive faster and it doesnt necessarily mean you will drive faster anyways
